Common use of Basic Engineering Designs Clause in Contracts

Basic Engineering Designs. The Concessionaire shall prepare the Basic Engineering Designs in accordance with the Technical Specifications, Applicable Laws and Applicable Permits. If the Concessionaire proposes to set up the Power Plant, the Concessionaire shall also submit the Basic Engineering Designs for the Power Plant. The Basic Engineering Designs shall be drawn to scale, with accurate dimensions, to minimize construction/renovation delays, disputes and cost overruns and to ensure smooth construction/renovation of the relevant Facilities. The Facilities should be designed in a manner such that the Concessionaire can obtain a consent to operate from the West Bengal Pollution Control Board for the operation of the Facilities. The Existing Facilities, wherever applicable, should be constructed and renovated such that the Existing Facilities can be operated in accordance with Design Standards, Applicable Laws and the Applicable Permits obtained for the Existing Facilities. The Basic Engineering Designs should also specify the Proposed Technology/Engineering for Tolly‟s Nallah STP 1, Tolly‟s Nallah STP 2 and Tolly‟s Xxxxxx XXX 0. Within 30 days from the Appointed Date, the Concessionaire shall submit 4 hard copies and 1 soft copy on a compact disc of the draft Basic Engineering Designs to the KMC for its review and approval. The KMC shall forward the Basic Engineering Designs to the Project Engineer and the Indian Institute of Technology (IIT) or other such reputed institutions for their review and comments. The KMC shall provide comments if any, on the draft Basic Engineering Designs (including any comments from IIT/other reputed institute and the Project Engineer) to the Concessionaire or notify the Concessionaire of its approval of the draft Basic Engineering Designs within 20 days from the date of receipt of the draft Basic Engineering Designs. The KMC may require the Concessionaire to amend or modify the draft Basic Engineering Designs if the KMC, IIT/other reputed institute or the Project Engineer identifies any deficiencies, inaccuracies or shortcomings in the draft Basic Engineering Designs. If the Concessionaire receives any comments, suggestions or instructions to modify the draft Basic Engineering Designs from the KMC, then the Concessionaire shall modify the draft Basic Engineering Designs to correct any such shortcomings, inaccuracies or deficiencies and/or address, in writing, the KMC's/IIT's/ other reputed institute‟s/the Project Engineer's comments on the draft Basic Engineering Designs and submit the revised Basic Engineering Designs to the KMC for its approval within 10 days of receipt of comments. The process set out in this Article 7.2(a)(i)(D) shall continue until the Basic Engineering Designs are certified by IIT/other reputed institute and are approved by the KMC in accordance with this Article 7.2(a)(i)(D).

The Basic Engineering Designs should also specify the Proposed Technology/Engineering Technology for Tolly‟s Nallah the Farrukhabad STP 1, Tolly‟s Nallah STP 2 and Tolly‟s Xxxxxx XXX 0. the Fatehgarh STP. (B) Within 30 days from the Appointed Date, the Concessionaire shall submit 4 hard copies and 1 soft copy on a compact disc of the draft Basic Engineering Designs to the KMC Executive Agency for its review and approval. . (C) The KMC Executive Agency shall forward the Basic Engineering Designs to the Project Engineer and the Indian Institute of Technology (IIT) or other such reputed institutions for their review and comments. . (D) The KMC Executive Agency shall provide comments if any, on the draft Basic Engineering Designs (including any comments from IIT/other reputed institute IIT and the Project Engineer) to the Concessionaire or notify the Concessionaire of its approval of the draft Basic Engineering Designs within 20 days from the date of receipt of the draft Basic Engineering Designs. The KMC Executive Agency may require the Concessionaire to amend or modify the draft Basic Engineering Designs if the KMCExecutive Agency, IIT/other reputed institute IIT or the Project Engineer identifies any deficiencies, inaccuracies or shortcomings in the draft Basic Engineering Designs. If the Concessionaire receives any comments, suggestions or instructions to modify the draft Basic Engineering Designs from the KMCExecutive Agency, then the Concessionaire shall modify the draft Basic Engineering Designs to correct any such shortcomings, inaccuracies or deficiencies and/or address, in writing, the KMC'sExecutive Agency's/IIT's/ other reputed institute‟sIIT's/the Project Engineer's comments on the draft Basic Engineering Designs and submit the revised Basic Engineering Designs to the KMC Executive Agency for its approval within 10 days of receipt of comments. The process set out in this Article 7.2(a)(i)(DClause 7.2(a)(iv) shall continue until the Basic Engineering Designs are certified by IIT/other reputed institute IIT and are approved by the KMC Executive Agency in accordance with this Article 7.2(a)(i)(DClause 7.2(a)(iv).

The Existing Facilities, wherever applicable, should be constructed and renovated such that the Existing Facilities can be operated in accordance with Design Standards, Applicable Laws and the Applicable Permits obtained for the Existing STP Facilities. The Basic Engineering Designs should also specify the Proposed Technology/Engineering Technology for Tolly‟s Nallah the Digha STP 1, Tolly‟s Nallah STP 2 and Tolly‟s Xxxxxx XXX 0. the Kankarbagh STP. (B) Within 30 days from the Appointed Date, the Concessionaire shall submit 4 hard copies and 1 soft copy on a compact disc of the draft Basic Engineering Designs to the KMC BUIDCO for its review and approval. The KMC . (C) BUIDCO shall forward the Basic Engineering Designs to the Project Engineer and the Indian Engineering Institute of Technology (IIT) or other such reputed institutions for their review and comments. The KMC . (D) BUIDCO shall provide comments if any, on the draft Basic Engineering Designs (including any comments from IIT/other reputed institute the Engineering Institute and the Project Engineer) to the Concessionaire or notify the Concessionaire of its approval of the draft Basic Engineering Designs within 20 days from the date of receipt of the draft Basic Engineering Designs. The KMC BUIDCO may require the Concessionaire to amend or modify the draft Basic Engineering Designs if BUIDCO, the KMC, IIT/other reputed institute Engineering Institute or the Project Engineer identifies any deficiencies, inaccuracies or shortcomings in the draft Basic Engineering Designs. If the Concessionaire receives any comments, suggestions or instructions to modify the draft Basic Engineering Designs from the KMCBUIDCO, then the Concessionaire shall modify the draft Basic Engineering Designs to correct any such shortcomings, inaccuracies or deficiencies and/or address, in writing, BUIDCO's/the KMC's/IIT's/ other reputed institute‟sEngineering Institute's/the Project Engineer's comments on the draft Basic Engineering Designs and submit the revised Basic Engineering Designs to the KMC BUIDCO for its approval within 10 days of receipt of comments. The process set out in this Article 7.2(a)(i)(DClause 7.2(a)(iv) shall continue until the Basic Engineering Designs are certified by IIT/other reputed institute the Engineering Institute and are approved by the KMC BUIDCO in accordance with this Article 7.2(a)(i)(DClause 7.2(a)(iv).
