Common use of Basis Clause in Contracts

Basis. Oakland will discipline or discharge a faculty member only for just cause. For purposes of this paragraph "just cause" shall be interpreted in the context of the principles of academic freedom and academic responsibility and shall be limited to: a. Failure to fulfill professional responsibilities. b. Professional misconduct. c. Conduct punishable as a felony under Michigan or Federal Law. d. Conduct violating Article XXIII of the Agreement. Discharge shall be deemed to refer only to termination of a faculty member's current employment agreement prior to its expiration date or to the termination of tenured employment.
