BID SECURITY DECLARATION. 12.1 In lieu of Bid Security / EMD, bidders (other than MSE / SSI unit registered with NSIC / MSME bodies) are required to submit "Bid Security Declaration" along with their bid in the format given in Section-VIII. 12.2 The Bid Security Declaration is required to protect the purchaser against the risk of bidder’s conduct, which would warrant the action as per Section-VIII. 12.3 The bid security declaration shall be in the form of Section-VIII. valid for a period of 150 days from the date of tender opening. 12.4 The bid not secured in accordance with para 12.1 & 12.3 shall be rejected by the Purchaser being non-responsive at the bid opening stage and returned to the bidder unopened. 12.5 If the bidder fails to comply with the conditions of bid security declaration as per Section-VIII, they will not be eligible to participate in the MTNL tender for any item / product for one year from the date of issue of APO/LOI. The bidder will not approach the court against the decision of MTNL in this regard.

BID SECURITY DECLARATION. In terms of the Tender, a Bidder will be required to submit Bid security declaration, along with its Bid (Bid Security Declaration as per format specified in Annexure-IX to be given). The Bid shall be summarily rejected if it is not accompanied by the Bid Security declaration.
BID SECURITY DECLARATION. The bidders are required to furnish a signed ‘Bid Security Declaration’ by their Authorised Signatory regarding accepting of the condition that if they withdraw or modify their bids during the period of bid validity, they will be suspended for the time specified in the tender documents for a period of twelve (12) months from the date of such withdrawal from bidding during the bid validity period. In this regard, Government of India, Ministry of Finance Dept. of Expenditure letter no. F.9/4/2020-PPD dated 12 Nov 2020 is relevant. Bid Security Declaration is placed at Enclosure 2 to this GeM bid.
BID SECURITY DECLARATION. Bidders to note that wherever Bid Security Declarations are allowed in NIT in lieu of EMD, there shall be no requirement of paying EMD. However, all bidders shall be required to mandatorily submit the Bid Security Declaration in lieu of EMD as per the standard format attached. The requirement of submission of Bid Security Declaration shall also be applicable on bidders who are exempted from payment of EMD (MSEs as per PPP, Start-ups, CPSEs and JVs). The bid shall be liable to be rejected if Bid Security Declaration in lieu of EMD is not uploaded in E-Tendering portal (GeM Portal) on or before tender submission date and time. (ANNEXURE- K)
