In critical circumstances where any delay involves a damage which it would be difficult to repair, a party may apply a provisional bilateral safeguard measure pursuant to a preliminary determination of the existence of a clear evidence that the increased imports from the other party have caused or are threatening to cause serious injury to the domestic industry.

A Party may adopt a provisional safeguard measure, in critical circumstances where any delay would cause damage difficult to repair to the domestic industry from like or directly competitive goods, based on a preliminary determination that there is clear evidence that increased imports have caused, or are threatening to cause, serious injury to the domestic industry.
