Billing Rates. Since we cannot determine in advance the exact nature and extent of the services to be rendered on your behalf, our fee will be based on the time actually devoted to your case at our regular hourly rates. My hourly rate for collaborative law representation in your matter will be $___ per hour in 20__. Our hourly rate in 20__ for paralegals is $___ per hour. Other attorneys who may work on your case will be charged at their applicable rates. Time is billed to the nearest tenth of an hour. Monthly Bills We will deduct our fees and costs which appear on your monthly bill from your funds held in trust. We render bills monthly. Payment is due upon receipt. It is important to us that any billing issues are resolved expeditiously and any corrections or adjustments that should be made are made promptly. Please review your bills from our offices and notify us within 20 days if you have any questions or concerns about any of the charges shown. If you do not notify us within 20 days from when a bill is sent of any concerns about the charges reflected on the bill, then we will not consider making any adjustments to the bill. Because of the nature of legal matters and proceedings, it is difficult to predict what the total fees and costs will be, even in a settlement or Collaborative Process context. I make no representation or guarantee concerning the outcome on matters for which I have been engaged, nor concerning your total fees, costs or expenses relating to this matter. Payment of attorneys’ fees and costs owed to me is in no way dependent upon or contingent upon your spouse. Overdue Accounts We do not extend credit. We expect you to pay your bill in full and to maintain your funds held in trust at the agreed‑upon amount. If we incur attorneys’ fees or costs to collect sums due from you, you will be responsible for all reasonable costs of collection including reasonable attorney’s fees.

Overtime will not be charge for report preparation. • There will be a two-hour minimum charge in case of work cancellation after our field personnel has been dispatched. • We will assess a minimum four-hour charge for services less than four hours and an eight hours for services between four and eight hours. • It is understood by both contracting parties that this will be a prevailing wage project as defined in Labor Code Sections 1770-1780. • Our rates will be adjusted if the prevailing wage is adjusted by the Department of Industrial Relations. • For on-call services, the test locations will be prepared and ready for testing by Converse field personnel upon their applicable rates. If we incur attorneys’ fees or costs to collect sums due from you, you client and/or contractor will be responsible for the excavation and backfilling of all reasonable costs test locations. • Additional inspections and laboratory testing outside the agreed-upon scope of collection work can be provided upon request. Charges for these additional services will be based on our attached Schedule of Fees. • No services will be provided prior to our signature of an agreement with you. No additional work required will be provided without written authorization and a budget amendment from your authorized representative. • Our services will be performed on a time-and-materials basis in accordance with the unit rates indicated, and/or Schedule of Fees and General Conditions. • Our field representative will not direct, supervise, or lay out the work of the contractor. Our services will not include a review or evaluation of the contractor's safety measures on or near the project. • Any meetings and/or consultation(s) requested by the client will also be charged in accordance with the attached Schedule of Fees. • Testing services outlined in this proposal will be performed at the request of your authorized representative. • If services are provided on as-needed basis, no comments regarding compaction procedures or observations will be made. Daily field reports indicating work performed and test locations will be provided as the testing is completed. • We require 24 hours advance notice for our services. We will, however, make every attempt to accommodate requests on shorter notice. CONVERSE CONSULTANTS Prevailing Wage Schedule of Fees Personnel Introduction It is the objective of Converse Consultants to provide its clients with quality professional and technical services and a continuing source of professional advice and opinions. Services will be performed in a manner consistent with that level of care and skill ordinarily exercised by members of the profession currently practicing in the same locality under similar conditions. This fee schedule is valid through August 15, 2016. Hourly Charges for Personnel Staff assignments will depend on personnel availability, job complexity, project site location and experience level required to satisfy the technical requirements of the project and to meet the prevailing standard of professional care.
