Board of Reference. (1) The Commission hereby appoints, for the purpose of this agreement, a Board of Reference consisting of a Chairman and two other members who shall be appointed to section 48 of the Industrial Arbitration Act, 1979.
(2) The Board of Reference is hereby assigned the function of determining any dispute between the parties in relation to any matter which under this agreement may be allowed, approved, fixed, determined or dealt with by a Board of Reference.
Board of Reference. 36.8.1 For the purposes of clause 36.7, a Board of Reference shall be constituted by a Chairperson as may be agreed upon by Australia Post and the Union, including those at the State level.
36.8.2 The General Manager of the FWC shall be requested to appoint a Board of Reference Chairperson for the duration of the Agreement where the parties are unable to agree to a Chairperson.
36.8.3 A Board of Reference shall seek to resolve any application for review submitted to it, having regard to whether the decision was harsh, unjust or unreasonable.
Board of Reference. (1) There shall be a Board of Reference consisting of a Chairman and an equal number of employers' and employees' members who shall be appointed pursuant to section 48 of the Industrial Relations Act 1979 and Regulation 16 of the Industrial Relations Commission Regulations 1985.
(2) The Board of Reference is hereby assigned the function of determining any dispute between the parties in relation to any matter which under this Award may be allowed, approved, fixed, determined or dealt with by a Board of Reference.
Board of Reference. Under this Agreement, no disputes between the Parties in relation to any matter will be determined by a Board of Reference.
Board of Reference. (1) The Commission hereby appoints for the purposes of this agreement, a Board of Reference consisting of a Chairman and two other members who shall be appointed pursuant to regulation 52 of the Industrial Arbitration Act (Western Australian Industrial Commission) Regulations, 1974.
(2) The Board of Reference is hereby assigned the function of determining any dispute between the parties in relation to any matter which, under this agreement may be allowed, approved, fixed, determined, or dealt with by a Board of Reference.
Board of Reference. For the purposes of clause 36.7, a Board of Reference shall be constituted by a Chairperson as may be agreed upon by Australia Post and the Union, including those at the State level.
Board of Reference. (1) The Commission hereby appoints for the purposes of this award, a Board of Reference consisting of a Chairman and two other members who shall be appointed pursuant to section 48 of the Industrial Arbitration Xxx 0000.
(2) The Board of Reference is hereby assigned the function of allowing, approving fixing, determining or dealing with any matter of difference between the parties in relation to any matter which, under this award, may be allowed, approved, fixed, determined or dealt with by a Board of Reference.
Board of Reference. 3.4.1. A Board of Reference shall be convened on the application of either an employee or the employer to deal with disputes over the correct classification of an employee covered by this Agreement, including eligibility for higher duty payments as provided for in clause 5.3.
3.4.2. The Board must apply the Agreement classification criteria in making a determination over any such disputes
3.4.3. The Board shall be constituted by a Chairperson (the Deputy Industrial Registrar for South Australia or their nominee) and two (2) other members, one on nomination by the employer and the other on nomination by the employee or their representative.
3.4.4. The employer and the employee may be represented before the Board of Reference.
3.4.5. The Board shall determine by majority decision any classification matter brought before it and publish the reasons for its determination.
3.4.6. The employer or the employee, or their representative, may appeal a Board determination to the Commission provided such appeal is lodged within 21 days of the Board determination.
3.4.7. Nothing contained in this clause shall prevent the employer, the employee or the employee’s representative from utilising the Dispute Avoidance/Settlement Procedure in clause 3.1 of the Agreement to deal with classification disputes and directly making access to the Commission in lieu of an application to a Board of Reference. However, if a party applies to the Commission to have a classification dispute determined, any proceedings before a Board of Reference on the same, or a similar issue will cease immediately and the role of the Board of Reference will come to an end.
Board of Reference. 27.3.1 The Board of Reference will consist of one person to be appointed from time to time by the Association and one person to be appointed from time to time by VHIA, with the Industrial Registrar of Fair Work Australia or his/her nominee as Chairperson, three of whom must form a quorum.
27.3.2 If a matter relating to job size is referred to a Board of Reference pursuant to sub-clause 27.2 above, instead of the Association and VHIA appointments made under sub-clause 27.3.1 above, the Association must agree on one nominee from the Department and one nominee who is an appropriate clinical expert.
27.3.3 The Decision of the Board of Reference is final. PART 4 - REMUNERATION
