Common use of Bumping and Demotion in Lieu of Layoff Clause in Contracts

Bumping and Demotion in Lieu of Layoff. A regular or probationary employee who is to be laid off shall have the right to bump an employee of lesser seniority in a class in which he/she previously held regular status within the department. If there are two or more employees to be laid off and they opt to exercise this right and request to bump to the same position, then the employee with the greatest classification seniority shall have the right to fill such position. If the classification seniority of these employees is equal, then the employee with the greatest continuous County service seniority shall have the right to fill such vacancy.
