Common use of Buy American requirement Clause in Contracts

Buy American requirement. 1. Parties to this contract must comply with P.L. 105-336 to the maximum extent practicable to purchase food products that are produced in the United States. 2. The Parties are permitted exceptions to the “Buy American” requirement under the following conditions: a. Products required for the preparation of catered meals are not produced or manufactured in the United States in sufficient and reasonable available quantities of a satisfactory quality; or b. The cost of the domestically produced food product that would be used in a catered meal is significantly higher than that of the foreign product.
