Buyer Equipment. Buyer is responsible for ensuring the performance, integrity and completeness of any Buyer-supplied equipment, instrumentation, software, documentation and other items used by Supplier in connection with its performance of the Services.

Buyer Equipment. All materials, tools, equipment and other property either furnished by Buyer to Seller or individually paid for by Buyer (“Buyer Equipment”) shall remain the property of Buyer, but Seller shall assume all risks of and be entirely responsible for any losses or damages arising from its use of Buyer Equipment. Upon completion or termination of this Agreement, Seller shall promptly return all Buyer Equipment in the condition in which Seller received it, taking into account reasonable wear and tear.
Buyer Equipment. If Buyer’s equipment, tools, or products (“Equipment”) are delivered to Seller, Seller will bear the entire risk of any damage to or loss, theft, or destruction of the Equipment from any cause whatsoever from the time delivered to Seller until returned to Buyer. During such time, Seller will maintain all-risk property insurance on the Equipment.
Buyer Equipment. All dies, tools, patterns, drawings, fixtures, etc. furnished by Buyer or specifically paid for by Buyer (the “Equipment”) shall belong to Buyer, be maintained in good condition and repair by Seller and be fully insured by Seller at Seller’s expense in an amount equal to the replacement cost with loss payable to Buyer. The Equipment shall be used exclusively for the purpose of fulfilling this order, shall be held in strict confidence by Seller, shall be safely stored, separate and apart from Seller’s property and shall not be used by or for or disclosed to others. Seller shall not modify the Equipment without the prior written consent of Buyer. Seller will post such signage as required to place third parties on notice that the Equipment is not Seller’s property. Seller will not allow any lien, mortgage or encumbrance (except, however, liens created by Buyer) to attach to the Equipment. Upon demand, the Equipment shall be returned to Buyer or made available for inspection by Buyer.

  • Customer Equipment Customer represents and warrants that it owns or has the legal right and authority, and will continue to own or maintain the legal right and authority during the term of this Agreement, to place and use the Customer Equipment as contemplated by this Agreement. Customer further represents and warrants that its placement, arrangement, and use of the Customer Equipment in the Internet Data Centers complies with the Customer Equipment Manufacturer's environmental and other specifications.

  • Computer Equipment No computers and/or personal electronic devices, such as tablets and laptop computers, or any component thereof, may be purchased with funds provided under this Contract, regardless of purchase price, without prior written approval of ADMINISTRATOR.   • New Equipment Where new types of equipment and/or operations, for which rates of pay are not established by this Agreement, are put into use after the ratification date of this Agreement within operations covered by this Agreement, rates governing such operations shall be subject to negotiations between the parties.   • Purchased Equipment 1. Any asset with an acquisition cost in excess of $5,000 must be capitalized. PROVIDER shall make requests for any exceptions to this policy in writing to the Fiscal and Management Services Administrator for COUNTY. These requests shall be made prior to the purchase of any such asset.

  • Computer Equipment Recycling Program If this Contract is for the purchase or lease of computer equipment, then Contractor certifies that it is in compliance with Subchapter Y, Chapter 361 of the Texas Health and Safety Code related to the Computer Equipment Recycling Program and the Texas Commission on Environmental Quality rules in 30 TAC Chapter 328.

  • Metering Equipment 13.01. Utility will furnish, install, own and maintain metering equipment capable of measuring the flow of kilowatt-hours (kWh) of energy. The Customer's service associated with the CRG will be metered at a single metering point. The metering equipment will measure energy delivered by Utility to Customer and also measure energy delivered by Customer to Utility. Customer agrees to provide safe and reasonable access to the premises for installation of this equipment and its future maintenance or removal.
