Cable TV/Fiber Optic Service. Upon application to the Town and approval of a franchise Agreement for such facilities, the Developer may install or cause to be installed underground all conduits and cable service/fiber optic lines within the Project at no expense to the Town. The Developer may contract with any cable TV/fiber optic provider of its own choice and grant an access and/or easement to such provider to furnish cable TV/fiber optic services for those dwelling units or other uses on the Project, so long as the property is private and not dedicated to the public.

Cable TV/Fiber Optic Service. Subject to all applicable federal and state laws, Property Owners may install or cause to be installed underground all conduits and cable service/fiber optic and other communication lines within the Project at no expense to the City. The conduits, cable, lines, connections and lateral connections shall remain the sole and exclusive property of Property Owners or cable/fiber optic and other communication provider even though the roadways in which the cable/fiber optic lines conduits, connections and laterals are installed may be dedicated to the City. Notwithstanding anything herein to the contrary, the City shall maintain the ability to charge and collect all taxes and/or fees with respect to such cable service and fiber optic lines as allowed under State Law.

In such case, Developer’s obligation to provide such service would no longer be required.
