Care Home Fees Judicial Review Appeal. The commitment set out in the RSA (Annex 6b) includes an interim assessment of the increase in care home fees associated the judicial review established in 2015/16. The Council have agreed to fund this in addition to the original opening baseline, along with any additional settlement agreed or instructed in the final decision on the judicial review appeal.

The appeal is now scheduled to be heard in June 2017 so this outstanding risk is carried forwards. In 2017/18 the Council took the decision on fees having consulted with colleagues in Torbay and South Devon NHS Foundation Trust. This decision remains interim pending the outcome of the above judicial review. The guidance and directions in terms of the BCF for 2017/18 are not available until post the general election June 2017. Once received the BCF commitments will form an addendum to the ASA.
