Common use of Certification and Reporting Requirements Clause in Contracts

Certification and Reporting Requirements. An employee taking a leave to care for a family member with a serious health condition or for his/her own serious health condition, may be required to provide medical certification and to undergo periodic recertification. For a qualifying exigency leave, the employee may be required to provide certification that the covered military member is a member of the National Guard or Reserves and is on active duty or called to active duty in support of a contingency operation. The employee may also be required to provide a certification about the nature and details of the specific exigency, the amount of leave needed, and the employee's relationship to the military member. Absent unusual circumstances, both certifications must be provided within 15 days from the date when the leave is requested. For a military caregiver leave, the employee may be required to provide information from the health care provider and team member and/or Covered Service Member to support such leave. Absent unusual circumstances, such certification must be provided within 15 days from the date when the leave is requested. HMH will also require periodic status reports from employees concerning their intended return date. An unexcused failure to provide requested documentation may result in the denial or suspension of the leave. HMH may attempt to clarify or authenticate the certification or may require additional certifications to support the need for the continuation of the leave. When a leave is taken to care for a family member, HMH may require the employee to provide documentation or a statement of family relationship (e.g., birth certificate or court document) and proof of the need to care for the family member.
