Change of Vehicle. 7.1 We reserve the right to substitute a comparable or superior Vehicle at no extra cost where unforeseen circumstances dictate. This shall not constitute a breach of contract and does not entitle the renter to any refund.
7.2 Should the renter decide to downgrade their Vehicle from that originally booked they will not be entitled to any refund.
Change of Vehicle. 8.1 In unforeseen circumstances, such as where the Vehicle has been involved in an accident, the Vehicle booked may no longer be available. Xxxxxx may offer substitute an alternative Vehicle for the Vehicle booked at no extra cost to You.

A refund will only be payable by Apollo where there has been a breach of the contract giving rise to the right for a refund or where a right to a refund arises under law including pursuant to the ACL.
