CHANNELING OF DISPUTES AND GRIEVANCES. All disputes and grievances arising under this Agreement shall be submitted to the LMCC for processing and must be heard and ruled upon by the Judicial Committee within ninety (90) calendar days after filing or either party may go directly to arbitration. The Union may file a grievance directly with the Employer and if the grievance is not resolved, then the Union or the Employer may refer the grievance to the LMCC for processing and must be heard and ruled upon by the Judicial Committee within ninety (90) calendar days of the occurrence of the alleged violation of this agreement, excluding violations found through an audit.
