City Responsibility. The City will perform no repairs, maintenance or snow removal on the improvements and easements until accepted by the City. The City agrees to maintain any easements once they have been accepted by the City. Trash and garbage removal service will be provided by the City upon the issuance of the first occupancy permit.
City Responsibility. 2.1 The CITY will furnish and pay for the actual cost of the materials, including any delivery or freight cost. The CITY will provide a purchase order and will be billed directly by the material supplier. The COUNTY may accumulate and xxxx the CITY for incidental material cost.
2.2 The CITY will pay for one-half of the COUNTY’s fuel used to construct this Project. The COUNTY will invoice the CITY for the fuel consumed at the conclusion of the Project.
2.3 The CITY will be responsible for all traffic control necessary to safely construct this project. This responsibility includes all advance notices, signage, barricades, pilot vehicles, and flagmen necessary to control traffic in and around the construction site. The CITY will be responsible for and provide portable message boards to supplement traffic control as needed.
2.4 The CITY will make all necessary repairs and preparations to the existing roadway prior to the COUNTY starting work.
2.5 The CITY will adjust all utilities, manholes and valve boxes for this Project.
2.6 The CITY will provide the COUNTY with a hydrant meter and all the water necessary for construction of the Project at no cost to the COUNTY.
2.7 The CITY will provide or pay for any engineering, survey, and laboratory testing required for this Project.
2.8 The CITY will furnish a nearby site for dumping all spoils and waste materials generated during construction of this Project.
2.9 The CITY will provide the material to backfill the pavement edges for this project.
2.10 If required, the CITY will be responsible for the design and development of a Storm Water Pollution Prevention Plan (SWPPP). The CITY further agrees to pay for all cost (including sub-contractor materials, labor and equipment) associated with the implementation of the plan. The COUNTY will be responsible for maintenance of the plan during the duration of the Project. Documentation and record keeping of the SWPPP will be the responsibility of the CITY.
City Responsibility. It shall be the responsibility of the City to determine in each instance if overtime work is required and, if so, how many employees will be required to perform the work.
City Responsibility. 1) Provide the necessary administration of committee and staff, and consult, collaborate and coordinate with BOX ELDER to accomplish the tasks as contained in the CY 2017 Unified Planning Work Program.
2) CITY shall provide to BOX ELDER assistance as outlined in the CY 2017 Unified Planning Work Program.
3) Arrange for and conduct meetings and conferences to review work details and make presentations to the principal participants and other interested groups as will best effect cooperation and understanding in the program.
City Responsibility. After the Authority attains required subsurface compaction, the City will provide labor, materials and equipment to saw cut and excavate the street cut area, fill with 6-inches of concrete, and apply a final lift of asphalt. The City will provide necessary traffic control during this time.
City Responsibility. 3.1 The CITY shall designate a Project Manager to act as the CITY’s representative with respect to the work performed under this Agreement.
3.2 The CITY shall give prompt written notice to the CONSULTANT whenever the CITY observes or otherwise becomes aware of a problem with the project.
City Responsibility. 6.1.1 Excluding permits and fees normally the responsibility of the Contractor, the City shall obtain all approvals, easements, and the like required for construction and shall pay for necessary assessments and charges required for construction, use or occupancy of permanent structures or for permanent changes in existing facilities.
City Responsibility. The Contract Manager will review the utility locates and make adjustments in the planting locations to accommodate any conflicts.
City Responsibility. 2.1 Coordinate the negotiation of agreements for the provision of bike share service specifically designated hereunder.
2.2 Bike share services will be delivered by an independent contractor(s) pursuant to CITY contract (the “Contractor”). The Contractor shall be duly qualified, licensed, trained, and have adequate equipment to perform services under this Agreement.
2.3 Consult with ASU on installation, operations and maintenance of bike share services on the ASU Tempe campus. CITY will install four Bike Share Stations on ASU’s Tempe campus (subject to removal per Section 2.7). CITY will give ASU (10) ten days notice prior to installing any of the bike share services. The Contractor is responsible for the day to day operations of the bike share system and will be on ASU’s property as needed in order to repair bicycles, racks and signs.
2.4 CITY will make available reports on ridership, applicable performance standards, and reasonable financial and operational data to ASU with respect to bike share services provided hereunder.
2.5 The CITY shall comply with all applicable laws, ordinances, regulations and codes of the federal, state and local governments.
2.6 To the extent required by Section 35-214 of the Arizona Revised Statutes, CITY agrees to retain records relating to this Agreement. CITY agrees to make those records available at reasonable times for inspection and audit by ASU or the Auditor General of the State of Arizona during the term of this Agreement and for a period of five (5) years after the completion of this Agreement. The records shall be provided at Arizona State University, Tempe, Arizona, or another location designated by ASU upon reasonable notice to CITY.
2.7 CITY reserves the right to remove a station on ASU’s Tempe campus, at CITY’s cost, if it is deemed by CITY to be underperforming.
2.8 CITY shall require that the Contractor acquire the necessary licenses to place, operate and maintain CITY property on ASU land.
2.9 CITY will retain ownership of the all bicycles and the Bike Share Stations. CITY will require the Contractor to secure appropriate insurance coverage over such property to insure against damage, theft, or other loss caused by third-parties and/or natural disaster. ASU will not be liable for any damage or loss of the bicycles and/or the Bike Share Stations, unless such liability or damage is directly caused by ASU.

In the event that any employee or group of employees files or commences any claim or action before any administrative agency or court against the Union, its officers, or representatives for any alleged act or omission related to the application, interpretation, or enforcement of the City’s drug testing program, the City shall indemnify the Union for any judgments, awards, fees, or costs, and hold the Union, its officers, and representatives harmless in the event of any such claim or action.
