City's Right to Perform Work. 6.3.1 If the Construction Manager's Work is stopped by the City under Paragraph 6.2, and the Construction Manager fails within seven (7) days of such stoppage to provide adequate assurance to the City that the cause of such stoppage will be eliminated or corrected, then the City may, without prejudice to any other rights or remedies the City may have against the Construction Manager, proceed to carry out the subject Work. In such a situation, an appropriate Change Order shall be issued deducting from the Contract Price the cost of correcting the subject deficiencies, plus compensation for the Project Architect's additional services and expenses necessitated thereby, if any. If the unpaid portion of the Contract Price is insufficient to cover the amount due the City, the Construction Manager shall pay the difference to the City.

City's Right to Perform Work. 6.3.1 If the Contractor's Work is stopped by the City under Paragraph 6.2, or if the Contractor persistently fails or refuses to perform the Work in accordance with this Contract, and the Contractor fails within three (3) days of such stoppage, failure, or refusal, to provide adequate assurance to the City that the cause of such stoppage will be eliminated or corrected, then the City may, without prejudice to any other rights or remedies the City may have against the Contractor, proceed to carry out the subject Work. In such a situation, an appropriate Change Order shall be issued deducting from the Contract Price the cost of correcting the subject deficiencies, plus compensation for the City’s Representative’s additional services and expenses necessitated thereby, if any. City's Right to Perform Work. The City and its agents and employees shall have the right, at any time and from time to time, to enter Fair Park to perform any maintenance, repairs, or Alterations to Fair Park, both interior or exterior, and of every kind or nature which may be required of the Foundation under this Agreement but which the Foundation has failed to perform after having received written notice from the City at least ninety (90) days prior to the City’s entry; provided, however, that such notice shall not be required in the event of an emergency condition threatening the health, safety and welfare of the general public. The Foundation shall not offer any obstruction or hindrance to any such maintenance, repairs or Alterations. Nothing contained in this section shall be deemed to impose on the City any obligation to perform any maintenance, repairs or Alterations to Fair Park.
City's Right to Perform Work. City reserves the right to perform work at the Project Site. This work may be performed by City Forces, utility owners, or their contractors. If Work to be performed by another party was not noted in this agreement, City will give written notice to Design- Builder ten (10) working days prior to the start of any work. If Design-Builder determines that the work being performed by City or others may interfere with or cause damages to Work being performed by Design-Builder, Design-Builder shall notify City in writing within three (3) days of City’s notice. If, after timely notice, damage or delay to the Work of Design-Builder results, Design-Builder may file a Claim for compensation per Section 3-7, “Claims.” City reserves the right to direct Design-Builder to solicit competitive bids for Extra Work or additional services. If required by City, Design-Builder shall obtain competitive bids from contractors acceptable to Design-Builder and shall deliver such bids to City, who will then determine, with the advice of Design- Builder, which bids will be accepted.

  • Authorization to Perform Services The Consultant is not authorized to perform any services or incur any costs whatsoever under the terms of this Agreement until receipt of a written Notice to Proceed from the City.

  • Owner’s Right to Stop Work The Owner reserves the right, for itself and for any designated Construction Inspector retained by Owner, upon observation of apparent nonconforming Work, to immediately stop the affected Work. If the Work is later determined by the Design Professional to be in fact conforming Work, then Contractor shall be entitled upon timely claim to a Change Order for payment by Owner of any reasonable Actual Costs actually incurred by Contractor in connection with the stop Work order and resumption of the Work, as well as an extension in the time for performance of the Work to the extent Contractor is delayed by Owner's stop Work order.   • City's Right to Proceed In the event this contract is terminated pursuant to Paragraph 8, then the City may take over the work and prosecute the same to completion, by contract or otherwise, and Contractor and its sureties shall be liable to the City for any costs over the amount of this contract thereby occasioned by the City. In any such case, the City may take possession of, and utilize in completing the work, such materials, appliances and structures as may be on the work site and are necessary for completion of the work. The foregoing provisions are in addition to, and not in limitation of, the rights of the City under any other provisions of the contract, city ordinances, and state and federal laws.

  • Right to Compel Performance Notwithstanding the foregoing, upon the occurrence of an event of Default, a non-Defaulting Interconnection Party shall be entitled to (a) commence an action to require the Defaulting Interconnection Party to remedy such Default and specifically perform its duties and obligations hereunder in accordance with the terms and conditions hereof, (b) withhold payments, (c) suspend performance hereunder, and (d) exercise such other rights and remedies as it may have in equity or at law; provided, however, that the Transmission Provider shall not terminate the Interconnection Service Agreement due to the failure of Interconnection Customer to make a payment hereunder unless such failure could reasonably be expected to have a material adverse effect on the Interconnected Transmission Owner.
