Claiming Compensation. The payment of a rebate is conditional on the Customer notifying OptiComm of the non- compliance within 3 months of the relevant issue and the amount of rebate and whether a rebate is payable will be determined by OptiComm in its sole discretion, acting in good faith.
Claiming Compensation. Compensation for damages shall be claimed within a reasonable period of t ime from when the grounds for compensation were discovered or should ha ve been discovered, but no later than one (1) year after the alleged damage event occurred. With respect to compensation claimed for a device, the claim shall be f i led within one (1 ) year of the device being delivered.
Claiming Compensation. The payment of a rebate is conditional on:
(a) the RSP notifying Opticomm of the non-compliance within 6 months of the relevant issue and the amount of rebate in accordance with clause 4.4 and whether a rebate is payable will be determined by Opticomm in its sole discretion, acting in good faith; and
(b) the RSP complying with its obligations under clause 4.2(a).
