Common use of Class Size Cap Clause in Contracts

Class Size Cap. The District shall not exceed the class maximums as set forth in Paragraph A of this Article by more than two (2) students. In applying the provisions of this Article to team teaching, class size shall be determined by the ratio of teachers to students. If it exceeds the maximums set forth in Paragraph A, it shall, within ten (10) school days, make the necessary arrangements to reduce the size of such class to no more than the two (2) student limit over the maximums in Paragraph A. Reduction in class size may be accomplished by transferring students to other classes of the same grade level, or feasible combination thereof; creating additional classes; or by the transfer or reassignment of teachers as provided in Article XII, “Transfer,” or Article XII, “Reassignments.” Exempted from the above are situations where two or more teachers voluntarily assemble classes for special instructional purposes, modular, or similar situations, and, also, any other over-ratio classes for which the teacher or teachers involved request of the administration in writing with a copy to the Association. The District shall also make a good faith effort to meet the maximum class sizes as set forth in Paragraph A of this Article, subject to possible constraints; such as, staff availability, classroom limitations and student transportation issues.
