Client Participant Records. 25 27.2.1 CONTRACTOR shall prepare and maintain accurate and clients 26 complete records of participants served and dates and type of services 27 provided under the terms of this Agreement in a form acceptable to 28 ADMINISTRATOR. client 1 27.2.2 All participant records related to services 2 provided under the terms of this Agreement shall be retained by CONTRACTOR for 3 a minimum of five (5) years from the date of final payment under this 4 Agreement or until all pending COUNTY, State and Federal audits are completed, 5 whichever is later. Notwithstanding anything to the contrary, upon 6 termination of this Agreement, CONTRACTOR shall relinquish control with 7 respect to client records to COUNTY in accordance with Subparagraph 44.2. 8 27.2.3 COUNTY may refuse payment for a claim if client records 9 are determined by COUNTY to be incomplete or inaccurate. In the event client 10 records are determined to be incomplete or inaccurate after payment has been 11 made, COUNTY may treat such payment as an overpayment within the provisions of 12 this Agreement.
