Common use of Collection of Personal Data Clause in Contracts

Collection of Personal Data. (a) In compliance with the provisions of French Data Protection Law No. 78-17 of 6 January 1978, as amended by the Law of 6 August 2004, the Factor automatically processes personal information relating to the corporate officers of the French Sellers and some of its employees, in particular, the Factor’s contact persons or the representatives that sign the Deeds of Transfer and related documents. (b) Personal data is processed and kept strictly to provide the services hereunder. However, the Factor may need to provide such data to other companies of the group to which it belongs, in particular, in the USA, in accordance with applicable law or regulations. In this regard, the French Sellers acknowledge and agree that its corporate officers and employees agree that the information referred to in this clause may be transferred. (c) The individuals in question may have access to their personal data and request that any errors relating to them be rectified or deleted by contacting the Factor’s sales department at the address mentioned in Clause 17.1.
