Processing of Personal Data. 1.1. With regard to the Processing of Personal Data, You are the controller and determine the purposes and means of Processing of Personal Data You provide to Us (“Controller”) and You appoint Us as a processor (“Processor”) to process such Personal Data (hereinafter, “Data”) on Your behalf (hereinafter, “Processing”). 1.2. The details of the type and purpose of Processing are defined in the Exhibits attached hereto. Except where the DPA stipulates obligations beyond the Term of the Agreement, the duration of this DPA shall be the same as the Agreement Term. 1.3. You shall be solely responsible for compliance with Your obligations under the applicable Data Protection Laws, including, but not limited to, the lawful disclosure and transfer of Personal Data to Us by upload of source data into the Cloud Service or otherwise. 1.4. Processing shall include all activities detailed in this Agreement and the instructions issued by You. You may, in writing, modify, amend, or replace such instructions by issuing such further instructions to the point of contact designated by Us. Instructions not foreseen in or covered by the Agreement shall be treated as requests for changes. You shall, without undue delay, confirm in writing any instruction issued orally. Where We believe that an instruction would be in breach of applicable law, We shall notify You of such belief without undue delay. We shall be entitled to suspend performance on such instruction until You confirm or modify such instruction. 1.5. We shall ensure that all personnel involved in Processing of Customer Data and other such persons as may be involved in Processing shall only do so within the scope of the instructions. We shall ensure that any person Processing Customer Data is subject to confidentiality obligations similar to the confidentiality terms of the Agreement. All such confidentiality obligations shall survive the termination or expiration of such Processing.

Processing of Personal Data. The contracting authority undertakes to process the personal data that are communicated to it under the framework of this procedure with the greatest care, in accordance with legislation on the protection of personal data (General Data Protection Regulation, GDPR). Where the Belgian law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data contains stricter provisions, the contracting authority will act in accordance with said law.
Processing of Personal Data. (a) SORACOM collects and processes personal data about the Subscriber, including name, e-mail, IP-address as well data on data uses and billing data in order to provide XXXXXXX’s service and for billing purposes. (b) By entering into this Agreement with SORACOM you explicitly consent to SORACOM processing personal data about you. (c) SORACOM will specify the policy for processing Subscribers’ personal information (the “Privacy Policy”), and post the Privacy Policy on SORACOM’s website.

The Parties commit themselves to respect applicable data protection laws and regulations and process Personal Data in accordance with the terms of this Agreement. 15.2 IUCN may share Personal Data of the Consultant and / or Consultant Key Personnel with the Donor and other IUCN partners strictly involved in the implementation of the Project. The Consultant shall limit access and use of Personal Data to that strictly necessary for the performance of this Agreement and shall adopt all appropriate technical and organizational security measures necessary to preserve the strictest confidentiality and limit access to Personal Data. 15.4 Where the Consultant engages another processor for carrying out specific processing activities on behalf of IUCN, the same data protection obligations as set out in this Agreement and the applicable law shall be imposed on that other processor by way of an agreement. Where that other processor fails to fulfil its data protection obligations, the Consultant shall remain fully liable to IUCN for the performance of that other processor’s obligations. 15.5 Where Personal Data is transferred to a country that has not been deemed to provide an adequate level of protection for Personal Data or to an International Organization within the meaning of Regulation (EU) 2016/679, the Consultant shall ensure that appropriate safeguards in accordance with applicable law are provided. 15.6 The Consultant shall promptly, and in any case within twenty-four (24) hours inform IUCN through the online form located at (xxxxx://xxxxxxx.xxxx.xxx/dataprotection/requestform), if it determines and/or discloses to a competent public authority and/or affected data subjects that a Personal Data breach has occurred.

Tyto údaje musí správce údajů (DZS) zpracovávat výhradně pro účely provádění, správy a kontroly smlouvy a pro účely ochrany finančních zájmů Finančních mechanismů EHP, včetně kontrol, auditů a vyšetřování. Osoby mají právo na přístup k vlastním osobním údajům a na jejich opravu. S veškerými dotazy o zpracování svých osobních údajů se musí za tímto účelem obracet na správce údajů (DZS). Osoby se mohou kdykoli obrátit na evropského inspektora ochrany údajů. DZS specifikoval ochranu osobních údajů v dokumentech Zásady zpracování osobních údajů a Oznámení o zpracování osobních údajů dostupných na webových stránkách xxx.xxx.xx. All personal data must be processed in accordance with the Regulation (EU) No. 2016/679 (General Data Protection Regulation). Such data must be processed by the data controller (DZS) solely for implementing, managing and monitoring the Agreement or to protect the financial interests of the EEA Financial Mechanism, including checks, audits and investigations. The individuals have the right to access and rectify their own personal data. For this purpose, they must send any queries to the data controller (DZS). They may have recourse at any time to the European Data Protection Supervisor. (c) When providing the SORACOM Air Global Service as a communications services provider, SORACOM will process any data processed for the purpose of the conveyance of a communication on an electronic communications network or for the billing thereof ("Traffic Data") as a data controller for the following purposes: (i) to provide and maintain the services; (ii) to calculate the Services Fees payable by the Subscriber, including other accounting, tax and billing purposes; (iii) to identify, investigate and protect against fraud, threats and unlawful or wrongful use of the services; (iv) for internal use for development and improvement of the services; and / or (v) as required by applicable law. (d) Soracom may disclose Traffic Data: (i) if required by applicable law, court order, or any other statutory or supervisory authority; or (ii) to SORACOM affiliates or third parties that are lawfully sub-processing the Traffic Data in order for Soracom to deliver the services. Soracom will anonymize or delete Traffic Data when Soracom no longer requires it for the purposes set forth in Article 19(c). (e) The Subscriber can access additional information about the personal data that is processed by XXXXXXX in the policy on XXXXXXX's website (the "Privacy Policy"), xxxxx://xxx.xxxxxxx.xx/privacy-policy-for-eu/. The Privacy Policy contains information on the purposes, legal basis for processing, recipients of personal data, data retention period and the rights of the Subscriber.
