Common use of Commanders Clause in Contracts

Commanders. a ) If, during the term of this AGREEMENT, the number of classified positions at the rank of Commander is increased from the current number of eighteen (18) authorized Commanders to either twenty (20) or twenty-one (21), such newly created positions shall be filled as follows: (1) Upon creation of the twentieth (20th) classified position at the rank of Commander, the Chief of Police shall be entitled on a one-time basis to fill that position by discretionary appointment of any Officer on the Commander Eligibility List in existence on the date the position is created. It is expressly understood and agreed by the Parties that no Officer shall have a right to fill such position by virtue of being on a reinstatement list. (2) Upon creation of the twenty-first (21st) classified position at the rank of Commander, the Chief of Police shall be entitled on a one-time basis to fill that position by discretionary appointment of any Officer on the Commander Eligibility List in existence on the date the position is created. It is expressly understood and agreed by the Parties that no Officer shall have a right to fill such position by virtue of being on a reinstatement list. (3) The Officers appointed in accordance with this Article will have full civil service protection. (4) This provision expires at the end of this AGREEMENT.

(4) This provision expires at the end of this AGREEMENT. a) A Lieutenant becomes eligible for promotion to the next immediate level after two (2) years in rank; and any test posted after December 31, 2023, eligibility shall additionally be based upon completion of all promotion phases outlined in the Commander promotion pilot program outlined in this Article.
