Commercial facilities. Objective: The provision of commercial facilities appropriately located in relation to the City, or to the region as a whole, and to communities and neighbourhoods within the City.
Commercial facilities. The establishment of any commercial or industrial facilities (other than those necessary in the operation or uses of the Property expressly permitted by this Easement) including, but not limited to, guest ranching, outfitting, commercial feed lot, any retail sales or service businesses, except as provided in Exhibit B, paragraph , restaurants, night clubs, campgrounds, trailer parks, motels, hotels, commercial recreation facilities, gas stations, retail outlets, or facilities for the manufacture or distribution of any product (other than products to be grown or produced on the Property in connection with purposes expressly permitted in Exhibit B hereto).
Commercial facilities. Other than with respect to the Hotel ------------ --------------------- Facilities, Guest Facilities, Parking Facilities and Docking Facilities which are subject to the other approvals set forth in this Agreement, the Developer shall obtain the City's prior written approval of the concept, use and location of all retail, commercial, amusement, shopping, entertainment, and service facilities, structures and improvements to be constructed by the Developer in the City of Hammond, Indiana (collectively, the "Commercial Facilities") prior to commencing the construction or installation of any such Commercial Facilities. In the event that the Developer provides the City with a site plan depicting any proposed Commercial Facilities that have been approved by the City pursuant to this Section 6.22, the City agrees to (a) cause such site plan to be reviewed by the Department of Planning of the City, and (b) cause the Department of Planning of the City to consult with the Developer to determine whether any rezonings or variances are required under the City Zoning Ordinance to construct the proposed Commercial Facilities as depicted on such site plan. Subject to Section 11.09 hereof and to the extent permitted by Applicable Laws, the City shall support the development of any Commercial Facilities approved by if pursuant to this Section 6.22, and shall support any necessary zoning approvals, the issuance of permits and other land use and infrastructure approvals required to develop those Commercial Facilities that are approved by the City pursuant to this Section 6.22.

In the event that a Party invokes the dispute resolution provisions identified in Section 15 with respect to the transfer of Operational Control over a facility, such facility shall not be transferred while the dispute resolution process is pending except pursuant to Section 4.5.2.

  • Other Facilities This Agreement reserves in each party the power to establish a temporary holding facility during a pandemic, riot, civil disobedience or natural disaster, to establish group homes or other care or rehabilitation facilities in furtherance of a social service program, to temporarily transfer Inmates to alternative detention facilities in order to respond to Xxxx overcrowding, a public health directive, or to comply with a final order of a federal court or a state court of record for the care and treatment of Inmates.

  • Facility Prudential is willing to consider, in its sole discretion and within limits which may be authorized for purchase by Prudential Affiliates from time to time, the purchase of Shelf Notes pursuant to this Agreement. The willingness of Prudential to consider such purchase of Shelf Notes is herein called the “Facility”. NOTWITHSTANDING THE WILLINGNESS OF PRUDENTIAL TO CONSIDER PURCHASES OF SHELF NOTES BY PRUDENTIAL AFFILIATES, THIS AGREEMENT IS ENTERED INTO ON THE EXPRESS UNDERSTANDING THAT NEITHER PRUDENTIAL NOR ANY PRUDENTIAL AFFILIATE SHALL BE OBLIGATED TO MAKE OR ACCEPT OFFERS TO PURCHASE SHELF NOTES, OR TO QUOTE RATES, SPREADS OR OTHER TERMS WITH RESPECT TO SPECIFIC PURCHASES OF SHELF NOTES, AND THE FACILITY SHALL IN NO WAY BE CONSTRUED AS A COMMITMENT BY PRUDENTIAL OR ANY PRUDENTIAL AFFILIATE.
