Common use of Commissioning and Handover Clause in Contracts

Commissioning and Handover. Without limiting clause 8.(iii) or the Subcontractor's obligations or liabilities, or the Contractor's or the Contractor's Representative's rights under clause 13., the Subcontractor must: fully co-operate with Other Contractors and otherwise to take all steps necessary to ensure: the timely, efficient and comprehensive commissioning of the Subcontract Works; and the smooth handover of the Subcontract Works to the Contractor and the initial occupation of the Subcontract Works by the Commonwealth; without limiting paragraph (a): comply with the: Commissioning and Handover Plan; and Commissioning, Handover and Takeover Guidelines; and in consultation with the Contractor's Representative, provide the Contractor with such other specific assistance as may be required by the Contractor's Representative to facilitate the timely, efficient and comprehensive commissioning of the Subcontract Works and the smooth handover of the Subcontract Works to the Contractor and the initial occupation of the Subcontract Works by the Commonwealth; as a condition precedent to Completion, hand to the Contractor's Representative, Other Contractor or other person nominated by the Contractor's Representative all Project Documents which are required for the use, operation and maintenance of the Subcontract Works or the relevant Stage; and as and when reasonably required by the Contractor's Representative, meet with the Contractor's Representative, and such Other Contractors or other persons as are nominated by the Contractor's Representative with a view to ensuring that the Commonwealth, the Contractor, and the Other Contractors or other persons have sufficient information to enable the Commonwealth, the nominated Other Contractors or other persons to: operate the Subcontract Works; maintain the Subcontract Works; or perform such other activities as may be required by the Contractor or the Commonwealth in respect of the Subcontract Works.

Without limiting clause 8.(iii8.17(a)(iii) or the Subcontractor's obligations or liabilities, or the Contractor's or the Contractor's Representative's rights under clause 13., the Subcontractor must: fully co-operate with Other Contractors and otherwise to take all steps necessary to ensure: the timely, efficient and comprehensive commissioning of the Subcontract Works; and the smooth handover of the Subcontract Works to the Contractor and the initial occupation of the Subcontract Works by the Commonwealth; without limiting paragraph (a): comply with the: Commissioning and Handover Plan; and Commissioning, Handover and Takeover Guidelines; and in consultation with the Contractor's Representative, provide the Contractor with such other specific assistance as may be required by the Contractor's Representative to facilitate the timely, efficient and comprehensive commissioning of the Subcontract Works and the smooth handover of the Subcontract Works to the Contractor and the initial occupation of the Subcontract Works by the Commonwealth; as a condition precedent to Completion, hand to the Contractor's Representative, Other Contractor or other person nominated by the Contractor's Representative all Project Documents which are required for the use, operation and maintenance of the Subcontract Works or the relevant Stage; and as and when reasonably required by the Contractor's Representative, meet with the Contractor's Representative, and such Other Contractors or other persons as are nominated by the Contractor's Representative with a view to ensuring that the Commonwealth, the Contractor, and the Other Contractors or other persons have sufficient information to enable the Commonwealth, the nominated Other Contractors or other persons to: operate the Subcontract Works; maintain the Subcontract Works; or perform such other activities as may be required by the Contractor or the Commonwealth in respect of the Subcontract Works.

Without limiting clause 8.(iii) 8.10()a()iii or the Subcontractor's obligations or liabilities, or the Contractor's or the Contractor's Representative's rights under clause 13., the Subcontractor must: fully co-operate with Other Contractors and otherwise to take all steps necessary to ensure: the timely, efficient and comprehensive commissioning of the Subcontract Works; and the smooth handover of the Subcontract Works to the Contractor to, and the initial occupation of the Subcontract Works by by, the CommonwealthContractor; without limiting paragraph (a): comply with thewith: its Commissioning and Handover Plan; and the Commissioning, Handover and Takeover Guidelines; and in consultation with the Contractor's Representative, provide the Contractor with such other specific assistance as may be required by the Contractor's Representative to facilitate the timely, efficient and comprehensive commissioning of the Subcontract Works and the smooth handover of the Subcontract Works to the Contractor and the initial occupation of the Subcontract Works by the CommonwealthContractor; as a condition precedent to Completion, hand to the Contractor's Representative, Representative or any Other Contractor or other person nominated by the Contractor's Representative all Project Documents which are required for the use, operation and maintenance of the Subcontract Works or the relevant StageSection; and as and when reasonably required by the Contractor's Representative, meet with the Contractor's Representative, Representative and such Other Contractors or other persons as are nominated by the Contractor's Representative with a view to ensuring that the Commonwealth, the Contractor, Contractor and the nominated Other Contractors or other persons have sufficient information to enable the Commonwealth, the nominated Other Contractors or other persons to: operate the Subcontract Works; maintain the Subcontract Works; or perform such other activities as may be required by the Contractor or the Commonwealth in respect of the Subcontract Works.

Without limiting clause 8.(iii8.17(a)(ii) or the Subcontractor's obligations or liabilities, or the Contractor's or the Contractor's Representative's rights under clause 13., the Subcontractor must: fully co-operate with the Commonwealth, the MCC Contract Administrator, the Contractor, the Contractor’s Representative and Other Contractors and otherwise to take all steps necessary to ensure: ensure the timely, efficient efficient, comprehensive and comprehensive smooth: commissioning of the Subcontract WorksWorks or each Stage (including the inspection and testing process); and the smooth handover of the Subcontract Works or each Stage to the Contractor Contractor; and the initial occupation occupation, use, operation and maintenance of the Subcontract Works or each Stage by the Commonwealth, the Contractor and Other Contractors; without limiting paragraph (a): comply with thewith: all commissioning and handover requirements described in the Subcontract, including the requirements in Annexure 1; its Commissioning and Handover Plan; and the Commissioning, Handover and Takeover Guidelines; as and in consultation with when required by the Contractor's ’s Representative, provide the Contractor with such other specific assistance as may be required by the Contractor's Representative Contractor to facilitate the timely, efficient efficient, comprehensive and comprehensive smooth: commissioning of the Subcontract Works or each Stage (including the inspection and the smooth testing process); handover of the Subcontract Works to the Contractor and the initial occupation of the Subcontract Works by the Commonwealth; as a condition precedent to Completion, hand or each Stage to the Contractor's Representative; and occupation, Other Contractor or other person nominated by the Contractor's Representative all Project Documents which are required for the use, operation and maintenance of the Subcontract Works or each Stage by the relevant StageCommonwealth, the Contractor and Other Contractors; and as and when reasonably required by the Contractor's ’s Representative, meet with the Commonwealth, the MCC Contract Administrator, the Contractor's Representative, the Contractor’s Representative and such Other Contractors or other persons as are nominated by for the Contractor's Representative with a view to purpose of ensuring that the Commonwealth, the MCC Contract Administrator, the Contractor, the Contractor’s Representative and the Other Contractors or other persons have sufficient information Project Documents to enable the Commonwealth, the nominated MCC Contract Administrator, the Contractor, the Contractor’s Representative and Other Contractors or other persons to: occupy, use, operate the Subcontract Works; and maintain the Subcontract WorksWorks or each Stage; or and perform such other activities as may be required by the Contractor or the Commonwealth in respect of the Subcontract WorksWorks or each Stage.

Without limiting clause 8.(iii8.9(a)(ii) or the Subcontractor's obligations or liabilities, or the Contractor's or the Contractor's Representative's rights under clause 13., the Subcontractor must: fully co-operate with the Commonwealth, the MCC Contract Administrator, the Contractor, the Contractor's Representative and Other Contractors Contractors, and otherwise to take all steps necessary to ensure: ensure the timely, efficient efficient, comprehensive and comprehensive smooth: commissioning of the Subcontract WorksWorks or each Section (including the inspection and testing process); and the smooth handover of the Subcontract Works or each Section to the Contractor Contractor; and the initial occupation occupation, use, operation and maintenance of the Subcontract Works or each Section by the Commonwealth, the Contractor and Other Contractors; and without limiting paragraph (a): comply with thewith: all commissioning and handover requirements described in the Subcontract including the requirements in Annexure 1; its Commissioning and Handover Plan; and the Commissioning, Handover and Takeover Guidelines; and in consultation with as and when required by the Contractor's Representative, provide the Contractor with such other specific assistance as may be required by the Contractor's Representative Contractor to facilitate the timely, efficient efficient, comprehensive and comprehensive smooth: commissioning of the Subcontract Works or each Section (including the inspection and the smooth testing process); handover of the Subcontract Works to the Contractor and the initial occupation of the Subcontract Works by the Commonwealth; as a condition precedent to Completion, hand or each Section to the Contractor's Representative; and occupation, Other Contractor or other person nominated by the Contractor's Representative all Project Documents which are required for the use, operation and maintenance of the Subcontract Works or each Section by the relevant StageCommonwealth, the Contractor and Other Contractors; and as and when reasonably required by the Contractor's Representative, meet with the Commonwealth, the MCC Contract Administrator, the Contractor's Representative, and such Other Contractors or other persons as are nominated by the Contractor's Representative with a view to and Other Contractors for the purpose of ensuring that the Commonwealth, the MCC Contract Administrator, the Contractor, the Contractor's Representative and the Other Contractors or other persons have sufficient information Project Documents to enable the Commonwealth, the nominated Other Contractors or other persons each of them to: occupy, use, operate the Subcontract Works; and maintain the Subcontract WorksWorks or each Section; or and perform such other activities as may be required by the Contractor or the Commonwealth in respect of the Subcontract WorksWorks or each Section.
