Common use of Commissioning and Handover Clause in Contracts

Commissioning and Handover. Without limiting clause 8.(iii) or the Subcontractor's obligations or liabilities, or the Contractor's or the Contractor's Representative's rights under clause 13., the Subcontractor must: fully co-operate with Other Contractors and otherwise to take all steps necessary to ensure: the timely, efficient and comprehensive commissioning of the Subcontract Works; and the smooth handover of the Subcontract Works to the Contractor and the initial occupation of the Subcontract Works by the Commonwealth; without limiting paragraph (a): comply with the: Commissioning and Handover Plan; and Commissioning, Handover and Takeover Guidelines; and in consultation with the Contractor's Representative, provide the Contractor with such other specific assistance as may be required by the Contractor's Representative to facilitate the timely, efficient and comprehensive commissioning of the Subcontract Works and the smooth handover of the Subcontract Works to the Contractor and the initial occupation of the Subcontract Works by the Commonwealth; as a condition precedent to Completion, hand to the Contractor's Representative, Other Contractor or other person nominated by the Contractor's Representative all Project Documents which are required for the use, operation and maintenance of the Subcontract Works or the relevant Stage; and as and when reasonably required by the Contractor's Representative, meet with the Contractor's Representative, and such Other Contractors or other persons as are nominated by the Contractor's Representative with a view to ensuring that the Commonwealth, the Contractor, and the Other Contractors or other persons have sufficient information to enable the Commonwealth, the nominated Other Contractors or other persons to: operate the Subcontract Works; maintain the Subcontract Works; or perform such other activities as may be required by the Contractor or the Commonwealth in respect of the Subcontract Works.
