Common use of Commissioning and Handover Clause in Contracts

Commissioning and Handover. Without limiting clause 8.9(a)(i)C or clause 13, the Contractor must: fully co-operate with any Commonwealth, State, Territory or local agencies or authorities and otherwise take all steps necessary to ensure: the timely, efficient and comprehensive commissioning of the Works; and the smooth handover of the Works to, and the initial occupation of the Works by, the occupants; without limiting paragraph (a): comply with its Commissioning and Handover Plan; and in consultation with the Contract Administrator, provide the Principal with such other specific assistance as may be required by the Contract Administrator to facilitate the timely, efficient and comprehensive commissioning of the Works and the smooth handover of the Works to the occupants, including providing the occupants with the required training to operate and maintain the Works (if required); as a condition precedent to Completion, hand to the Contract Administrator or other person nominated by the Contract Administrator all Project Documents which are required for the use, operation and maintenance of the Works or the relevant Section; and as and when reasonably required by the Contract Administrator, meet with the Contract Administrator and such other persons as are nominated by the Contract Administrator with a view to ensuring that the Principal and the nominated persons have sufficient information to enable the Principal or the nominated persons to: operate the Works; maintain the Works; or perform such other activities as may be required by the Principal in respect of the Works.
