Common use of Commissioning and Handover Clause in Contracts

Commissioning and Handover. Without limiting clause 8.9(a)(ii) or clause 13, the Subcontractor must: fully co-operate with the Commonwealth, the MCC Contract Administrator, the Contractor, the Contractor's Representative and Other Contractors, and take all steps necessary to ensure the timely, efficient, comprehensive and smooth: commissioning of the Subcontract Works or each Section (including the inspection and testing process); handover of the Subcontract Works or each Section to the Contractor; and occupation, use, operation and maintenance of the Subcontract Works or each Section by the Commonwealth, the Contractor and Other Contractors; and without limiting paragraph (a): comply with: all commissioning and handover requirements described in the Subcontract including the requirements in Annexure 1; its Commissioning and Handover Plan; and the Commissioning, Handover and Takeover Guidelines; and as and when required by the Contractor's Representative, provide the Contractor with such other specific assistance as may be required by the Contractor to facilitate the timely, efficient, comprehensive and smooth: commissioning of the Subcontract Works or each Section (including the inspection and testing process); handover of the Subcontract Works or each Section to the Contractor; and occupation, use, operation and maintenance of the Subcontract Works or each Section by the Commonwealth, the Contractor and Other Contractors; and as and when required by the Contractor's Representative, meet with the Commonwealth, the MCC Contract Administrator, the Contractor, the Contractor's Representative and Other Contractors for the purpose of ensuring that the Commonwealth, the MCC Contract Administrator, the Contractor, the Contractor's Representative and Other Contractors have sufficient Project Documents to enable each of them to: occupy, use, operate and maintain the Subcontract Works or each Section; and perform such other activities as may be required by the Contractor or the Commonwealth in respect of the Subcontract Works or each Section.

Without limiting clause 8.9(a)(ii8.17(a)(ii) or clause 13, the Subcontractor must: fully co-operate with the Commonwealth, the MCC Contract Administrator, the Contractor, the Contractor's ’s Representative and Other Contractors, Contractors and take all steps necessary to ensure the timely, efficient, comprehensive and smooth: commissioning of the Subcontract Works or each Section Stage (including the inspection and testing process); handover of the Subcontract Works or each Section Stage to the Contractor; and occupation, use, operation and maintenance of the Subcontract Works or each Section Stage by the Commonwealth, the Contractor and Other Contractors; and without limiting paragraph (a): comply with: all commissioning and handover requirements described in the Subcontract Subcontract, including the requirements in Annexure 1; its Commissioning and Handover Plan; and the Commissioning, Handover and Takeover Guidelines; and as and when required by the Contractor's ’s Representative, provide the Contractor with such other specific assistance as may be required by the Contractor to facilitate the timely, efficient, comprehensive and smooth: commissioning of the Subcontract Works or each Section Stage (including the inspection and testing process); handover of the Subcontract Works or each Section Stage to the Contractor; and occupation, use, operation and maintenance of the Subcontract Works or each Section Stage by the Commonwealth, the Contractor and Other Contractors; and as and when required by the Contractor's ’s Representative, meet with the Commonwealth, the MCC Contract Administrator, the Contractor, the Contractor's ’s Representative and Other Contractors for the purpose of ensuring that the Commonwealth, the MCC Contract Administrator, the Contractor, the Contractor's ’s Representative and Other Contractors have sufficient Project Documents to enable each of them the Commonwealth, the MCC Contract Administrator, the Contractor, the Contractor’s Representative and Other Contractors to: occupy, use, operate and maintain the Subcontract Works or each SectionStage; and perform such other activities as may be required by the Contractor or the Commonwealth in respect of the Subcontract Works or each SectionStage.

Without limiting clause 8.9(a)(ii) 8.10()a()iii or the Subcontractor's obligations or liabilities, or the Contractor's or the Contractor's Representative's rights under clause 13, the Subcontractor must: fully co-operate with the Commonwealth, the MCC Contract Administrator, the Contractor, the Contractor's Representative Other Contractors and Other Contractors, and otherwise to take all steps necessary to ensure ensure: the timely, efficient, efficient and comprehensive and smooth: commissioning of the Subcontract Works or each Section (including Works; and the inspection and testing process); smooth handover of the Subcontract Works or each Section to to, and the Contractor; and occupation, use, operation and maintenance initial occupation of the Subcontract Works or each Section by the Commonwealthby, the Contractor and Other ContractorsContractor; and without limiting paragraph (a): comply with: all commissioning and handover requirements described in the Subcontract including the requirements in Annexure 1; its Commissioning and Handover Plan; and the Commissioning, Handover and Takeover Guidelines; and as and when required by in consultation with the Contractor's Representative, provide the Contractor with such other specific assistance as may be required by the Contractor Contractor's Representative to facilitate the timely, efficient, efficient and comprehensive and smooth: commissioning of the Subcontract Works or each Section (including and the inspection and testing process); smooth handover of the Subcontract Works or each Section to the Contractor; and occupationas a condition precedent to Completion, hand to the Contractor's Representative or any Other Contractor or other person nominated by the Contractor's Representative all Project Documents which are required for the use, operation and maintenance of the Subcontract Works or each Section by the Commonwealth, the Contractor and Other Contractorsrelevant Section; and as and when reasonably required by the Contractor's Representative, meet with the Commonwealth, the MCC Contract Administrator, the Contractor, 's Representative and such Other Contractors or other persons as are nominated by the Contractor's Representative and Other Contractors for the purpose of with a view to ensuring that the Commonwealth, Contractor and the MCC Contract Administrator, the Contractor, the Contractor's Representative and nominated Other Contractors or other persons have sufficient Project Documents information to enable each of them the nominated Other Contractors or other persons to: occupy, use, operate and the Subcontract Works; maintain the Subcontract Works Works; or each Section; and perform such other activities as may be required by the Contractor or the Commonwealth in respect of the Subcontract Works or each SectionWorks.

Without limiting clause 8.9(a)(ii8.17(a)(iii) or the Subcontractor's obligations or liabilities, or the Contractor's or the Contractor's Representative's rights under clause 13, the Subcontractor must: fully co-operate with the Commonwealth, the MCC Contract Administrator, the Contractor, the Contractor's Representative Other Contractors and Other Contractors, and otherwise to take all steps necessary to ensure ensure: the timely, efficient, efficient and comprehensive and smooth: commissioning of the Subcontract Works or each Section (including Works; and the inspection and testing process); smooth handover of the Subcontract Works or each Section to the Contractor; Contractor and occupation, use, operation and maintenance the initial occupation of the Subcontract Works or each Section by the Commonwealth, the Contractor and Other Contractors; and without limiting paragraph (a): comply withwith the: all commissioning and handover requirements described in the Subcontract including the requirements in Annexure 1; its Commissioning and Handover Plan; and the Commissioning, Handover and Takeover Guidelines; and as and when required by in consultation with the Contractor's Representative, provide the Contractor with such other specific assistance as may be required by the Contractor Contractor's Representative to facilitate the timely, efficient, efficient and comprehensive and smooth: commissioning of the Subcontract Works or each Section (including and the inspection and testing process); smooth handover of the Subcontract Works or each Section to the Contractor and the initial occupation of the Subcontract Works by the Commonwealth; as a condition precedent to Completion, hand to the Contractor; and occupation's Representative, Other Contractor or other person nominated by the Contractor's Representative all Project Documents which are required for the use, operation and maintenance of the Subcontract Works or each Section by the Commonwealth, the Contractor and Other Contractorsrelevant Stage; and as and when reasonably required by the Contractor's Representative, meet with the CommonwealthContractor's Representative, the MCC Contract Administrator, the Contractor, and such Other Contractors or other persons as are nominated by the Contractor's Representative and Other Contractors for the purpose of with a view to ensuring that the Commonwealth, the MCC Contract AdministratorContractor, and the Other Contractors or other persons have sufficient information to enable the Commonwealth, the Contractor, the Contractor's Representative and nominated Other Contractors have sufficient Project Documents to enable each of them or other persons to: occupy, use, operate and the Subcontract Works; maintain the Subcontract Works Works; or each Section; and perform such other activities as may be required by the Contractor or the Commonwealth in respect of the Subcontract Works or each SectionWorks.
