Commitment to Consultation. 41.1. The parties to this Agreement recognise that for the Agreement to be successful, the initiatives contained within this Agreement need to be implemented through an open and consultative process between the parties. 41.2. The parties to this Agreement are committed to involving employees and their union representatives in the decision–making processes that may affect the workplace. Employees will be encouraged to participate in the consultation processes by being allowed adequate time to understand, analyse, seek appropriate advice from their union and respond to such information. 41.3. The requirement of consultation is never to be treated perfunctorily or as a mere formality" (Port Louis Corporation v. Attorney-General of Mauritius (1965) AC 1111 at 1124).
