Communication of the Contracting Parties. 13.1. The Contracting Parties have agreed that written communication under this Contract or relating to the present Contract shall be delivered by the registered mail via post office or in person to the address given in the header of the present Contract or to another address notified in writing to the other Contracting Party in course of the present Contract, in e-mail during common communication and sending a return acknowledgment e-mail by the recipient, while a message automatically generated by the system is not considered a return confirmation e- mail of the recipient. The day of receipt of the document is considered the day of taking over the document. In case the addressee denies to take over the document within deposit deadline at the post office, the day of refusal to take over the document is considered the day of delivery. If the addressee does not collect the document within the deposit time period at the post office, the document is considered delivered on the same day it is returned to the sender by post office, even if the addressee does not learn about it. In case that document is returned to the sender with the postmark "addressee unknown" or "addressee has moved" or with another note of similar meaning, the day of delivery is considered the same day of return of the document to the sender.

  • Communications Protocol The Parties agree to be bound by the terms and conditions of the communications protocol provided for in Schedule “G” (Communications Protocol).

  • COMMUNICATION AND SERVICE OF DOCUMENTS 14.1 Sending communication to you We may send all communication to you by leaving it at, or by sending it by ordinary post to, your last known address (whether within or outside Singapore and whether such address is a Post Office Box or is a place of residence or business) or by facsimile transmission to your facsimile number as may be provided to us or to our solicitors. Notwithstanding the above, we may also contact you via telephone, electronic mail, short message service provided by telecommunications providers, or such other means, to provide you with account related information (including informing your account payment status.) You shall inform us upon receipt of communication that is garbled, incomplete or inaccurate or which is not intended for you and you agree to delete all such information from your equipment immediately

  • Representatives and Notices Each Party nominates as its representative for this Agreement the person set out on the first page of this Agreement under ‘Contact for Notices’ (“Representative”). Any communication under this Agreement must be in writing and sent to the recipient Party’s Representative. MATERIALS In the event that a Party (Provider) provides the other Party (User) with Material: the Material will be solely owned by the Provider; the User must store, handle and use the Material in compliance with all applicable legislation, regulations, codes and guidelines; the User must use the Material solely for the purpose of the Project and for no other purpose; the User must not use the Material in human subjects; the User must not, without the prior written consent of the Subject: transfer, distribute or disclose the Material to any third party external to the User; use the Material for commercial, diagnostic or therapeutic purposes; acknowledges that the Material are: experimental in nature and may have defects, deficiencies and hazardous properties; provided by the Provider without warranty, express or implied, and to the full extent permitted by law, all warranties related to the Material are excluded; and stored, handled and used at the Users’ sole risk. To the extent that the Provider has any legal rights in the Material, the Provider grants to the User a non-exclusive royalty free, transferable, worldwide licence to use, adapt and modify the Material for the purpose of performing the Project and carrying out its obligations under this Agreement and in accordance with the relevant Clinical Subject consent. Following termination of a Project and upon receipt of a written request by the Provider, the User must promptly return to the Provider (at the Provider’s expense) or destroy any unused Materials.

The tvOS Software may enable access to Apple’s iTunes Store, App Store, Game Center, iCloud and other Apple and third party services, and web sites (collectively and individually, “Services”). Such Services may not be available in all languages or in all countries. Use of these Services requires Internet access and use of certain Services may require an Apple ID, may require you to accept additional terms and may be subject to additional fees.   • Information and Services Required of the Owner § 3.1.1 The Owner shall provide information with reasonable promptness, regarding requirements for and limitations on the Project, including a written program which shall set forth the Owner’s objectives, constraints, and criteria, including schedule, space requirements and relationships, flexibility and expandability, special equipment, systems, sustainability and site requirements.

  • APPROVAL OF GENERAL COMMUNICATIONS Competitive Supplier may only communicate with Program participants and/or use the lists of Eligible Consumers/Program participants to send Department-approved education materials, opt- out notices, or other communications essential to the operation of the Program. Such lists may not be used by Competitive Supplier to market any additional products or services to Eligible Consumers or Program Participants. Competitive Supplier shall cooperate with and assist the Town in the drafting and sending of messages and information to Eligible Consumers concerning the Program or any matter arising under or related to this Agreement or the Program. Competitive Supplier shall, prior to sending any direct mail, advertising, solicitation, bill insert, electronic mail, or other similar written or electronic communication (collectively, “General Communications”) to Participating Consumers (but excluding individually drafted or tailored communications responding to a specific complaint or communication of an individual consumer), provide a copy of such General Communication to the Town for its review (for consistency with the Town’s purposes and goals) and approval. The Town shall have the right to disapprove such General Communications and suggest revisions if it finds the communication inconsistent with the purposes and goals of the Town, factually inaccurate, not essential to the operation of the program, or likely to mislead provided, however, that: (i) the communication shall be deemed approved if the Town fails to respond within ten (10) Business Days, and (ii) no approval shall be necessary for any communication (a) regarding any emergency situation involving any risk to the public health, safety or welfare; (b) that has been approved by the Department, the DOER; or (c) in the nature of routine monthly or periodic bills, or collection notices, except that any bill insert or message included at the bottom of such bill not within the scope of (a) or (b) above shall require advanced review and approval by the Town; and (iii) no approval or lack of approval shall relieve the Competitive Supplier of its obligations and responsibility for its actions and omissions under this Agreement, or other than as set forth in sub-clause ‘i’ of this Section 7.6, result in a waiver of any rights, remedies or defenses of the Town. The Town may reject or exclude any proposed General Communication that, in its reasonable judgment, is contrary to the interests and objectives of the Program or the Town.

  • REQUESTS FOR DATA BY THIRD PARTIES Unless prohibited by law, Contractor shall notify the Authorized User in Writing within 24 hours of any request for Data (including requestor, nature of Data requested and timeframe of response) by a person or entity other than the Authorized User, and the Contractor shall secure Written acknowledgement of such notification from the Authorized User before responding to the request for Data. Unless compelled by law, the Contractor shall not release Data without the Authorized User’s prior Written approval.
