Communications by email. Subject to clause 18.7, if a communication is emailed, a delivery confirmation report received by the sender, which records the time that the email was delivered to the addressee’s last notified email address is prima facie evidence of its receipt by the addressee, unless the sender receives a delivery failure notification indicating that the electronic mail has not been delivered to the addressee or an “out of office” notification.

Communications by email. Each party accepts that the use of email carries risks when used as part of a contractual process as it may not be apparent that emails or attachments have been received without corruption, or at all, by the other party. The Company will accept no liability for the non-receipt or corruption of emails or attachments.
