Common use of Complaint Concerning Job Postings Clause in Contracts

Complaint Concerning Job Postings. An employee who is unsuccessful as a result of a job posting process, as provided in Article 15, and disagrees with the decision made concerning his/her candidacy shall first give the hiring manager an opportunity to meet and discuss the recruitment process and provide the employee with the rationale for his/her decision. The hiring manager may be accompanied by another excluded employee at such a meeting. Such a meeting/discussion shall take place within (6) working days after the decision was communicated to the employee concerned by the Human Resources Department. This period shall be reasonably extended if the circumstances, such as the employee's absence, warrant. The employee may be accompanied by a representative of the Union (e.g. the appropriate Xxxxxxx), during such discussion if the employee wishes. A decision regarding any adjustment shall be made and communicated to the employee by the hiring manager within the next five (5) working days following the discussion. If the decision is not satisfactory or if none is communicated within the time limit referred to above, the employee may lodge a grievance.
