Conditions Precedent to Issuance of the TIF Notes. Within 15 business days after (1) acceptance or deemed acceptance of the Certificate of Substantial Completion pursuant to Section 3.10, (2) approval by the City of a Certificate of Reimbursable Redevelopment Project Costs pursuant to Section 4.2, (3) calculation of any adjustment to the Maximum Reimbursement Amount pursuant to Section 5.6, and
Conditions Precedent to Issuance of the TIF Notes. Within 15 business days after acceptance by the City of a Certificate of Reimbursable Redevelopment Project Costs for each Phase and the City’s approval of the Note Ordinance, the City shall issue the TIF Notes, or endorsements to outstanding TIF Notes, subject to the limitations of Article IV and this Section. Upon the acceptance by the City of a Certificate of Reimbursable Redevelopment Project Costs for each Phase and the issuance of the TIF Notes as provided herein, the Developer shall be deemed to have advanced funds necessary to purchase such TIF Notes and the City shall be deemed to have deposited such funds in the Project Fund and shall be deemed to have reimbursed the Developer in full for such costs from the amounts deemed to be on deposit in the Project Fund from time to time for each Phase.
