Confidentiality Compliance. 23.1. Contractual parties are obliged to maintain confidentiality regarding all unpublished information marked as confidential and received during the execution of the freight forwarding contract. Information can only be used for the exclusive purpose of contract fulfilment. Information in the public domain or objectively not requiring secrecy for the other contracting party is excluded.
Confidentiality Compliance. If Customer or Optum believes that one of hCentive’s Personnel performing Services under this Agreement has violated any provision of the Data Management and Confidentiality Agreement, Optum will notify hCentive, and may require that such hCentive Personnel immediately cease performing Services under the Agreement. Upon 24-hour notice to hCentive, Customer shall have the right to visit any of hCentive’s offices where Services are being performed for the purpose of verifying and ensuring the confidentiality of the Confidential Information.

Any records used or developed by ACCMP’s members, a listed ISST, or a listed Prevention Program that relate to a particular person are to be kept confidential and may not be released to any other person or agency, except as provided by law as noted in Appendix A, Article XVI. The Parties have developed a release of information that addresses the confidentiality needs of all Parties attached as and Appendix C.
