Common use of Confidentiality of Member Medical Records and Other Information Clause in Contracts

Confidentiality of Member Medical Records and Other Information. The Contractor shall ensure that member medical records, as well as any other health and enrollment information that contains individually identifiable health information, is used and disclosed in accordance with the privacy requirements set forth in the Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule (see 45 CFR parts 160 and 164, subparts A and E, which address security and privacy of individually identifiable health information, 42 CFR 438.208(b)(6), and 42 CFR 438.224). The Contractor shall also comply with all other applicable state and federal privacy and confidentiality requirements.

The Contractor shall have written policies and procedures pertaining to maintaining the confidentiality of all medical records and other pertinent information, including, but not limited to, health and enrollment information.
