Construction and Construction Engineering. The construction and construction engineering as any costs attributable to the project and falling within the parameters of the FHWA “construction project phase” (hereinafter “Const. & CE” including utilities and railroad). The following are the costs/funding commitments for the Const. & CE for the Project (Sections 1-4 below are totals that encompass the amounts listed in Section 6a-e below):

Construction and Construction Engineering. LPA agrees to cause the project to be constructed in compliance with the approved PS&E package, State approved change orders, and applicable rules, regulations and statues. The construction of this project will require a) the services of the RC as LPA’s representative, b) construction oversight by a licensed professional engineer (see Neb. Rev. Stat. § 81-3445), and c) a State Representative from the District whose review of the project’s construction will relate solely to the eligibility of the project for federal funding. Trans*Port SiteManager shall be used as the construction record-keeping system for construction and construction engineering services for this project. The RC and construction Consultants must complete State’s training in the use of Trans*Port SiteManager software.

Mechanisms are to be constructed to avoid sticking due to rust or corrosion. Workmanship and general finish are to be of the highest class throughout. All similar parts of the material are to be interchangeable. All equipment is to operate without undue vibration and with the least possible amount of noise and is not to cause a nuisance. All equipment is to be designed to minimize the risk of fire and any damage, which may be caused in the event of fire. The equipment is also to be designed to prevent ingress of all vermin, accidental contact with live parts and to minimize the ingress of dust and dirt. The use of materials, which may be liable to attack by termites or other insects, is to be avoided.
