Consumer Confidentiality. Union representatives and Family Child Care Providers shall maintain strict standards of confidentially regarding any consumers and any child under parental control of a consumer receiving subsidized child care and shall not disclose personal information pertaining to consumers or any child under parental control of a consumer from any source unless the disclosure is with the express written consent of the consumer, compelled by legal process, or otherwise by law.

Consumer Confidentiality. (A) Each party shall be prohibited from disclosing or using any nonpublic personal financial information or nonpublic personal health information (collectively, "Nonpublic Personal Information") related to any policyholder or beneficiary, or to any consumer or customer (as such terms are defined under applicable state or federal privacy laws), except (i) as necessary to carry out the party’s duties and obligations under this Agreement, (ii) as is reasonably necessary to th e party ’ s auditors, accountants, counsel, advisors and regulators who are under an obligation to maintain the confidentiality of the Nonpublic Personal Information, and (iii) as otherwise required under applicable state or federal law, including, without limitation, the ▇▇▇▇▇-▇▇▇▇▇-▇▇▇▇▇▇ Financial Services Modernization Act and any state law or regulation implementing the same. (B) Each party shall take such commercially reasonable steps to assure the confidentiality of the Nonpublic Personal Information. Each party or its representatives shall be entitled to audit the other party’s use of, and procedures to protect, Nonpublic Personal Information directly related to this Agreement at any reasonabletime upon prior written notice.
