Context of Use. 1.1 Europeana Inside within the digital cultural ecosystem for Europe In order to outline the requirements for Europeana Inside and its ECK, a first step is to look at the context in which the ECK will be deployed. This includes, most notably, the Europeana aggregation landscape and its stakeholders. However it is useful to extend the contextual overview to what can be described as the ‘digital cultural ecosystem for Europe’, in which Europeana is being increasingly seen as the central portal (see e.g. European Commission, 2011). The value network around Europeana is complex and layered. It includes many stakeholders in different configurations and interdependencies. The cultural institutions that contribute to Europeana are not only very diverse, but can also follow various paths to become a contributor. Previous research has already mapped the Europeana aggregator landscape in detail. A report, published in July 2012, in the context of Europeana v2 focused extensively on the value network or partner network in order to outline Europeana’s partner strategy (Xxxxxxx, Xxxxx & Xxxxxxxx, 2012). The report was written from Europeana’s point of view but it also takes other stakeholders’ requirements into account, and as such, it is highly relevant for the context of Europeana Inside. This section does not intend to duplicate the efforts of the Europeana v2 report, but it will complement it with value network approaches. In other words, the focus will be on the Europeana value network as a whole rather than Europeana itself. As a result we will look more directly and more in depth at the roles of other stakeholders within the Europeana Inside project and beyond. From the perspective of Europeana Inside, there are four main parties involved in this value network that contribute to the creation of end user services: • Content providers; • Aggregators; • Collection management software vendors; • Europeana. We will discuss these below. This value network description will serve as a background to the requirement analysis of Europeana Inside. An overview of the main stakeholders, the most important business relations and interdependencies between them is a necessary first step to gain insight into the workflows of the delivery of digital content to Europeana, and to define requirements that need to be taken into account within Europeana Inside. Context of Use. Licensee declares and warrants to be familiar with the characteristics and constraints of the Internet, the response time to consult, question or transfer information. Licensee insures to be informed of the security measures implemented by the Company, but recognizes that, due to the characteristics of the Internet, security is analyzed for the Company by an obligation of means. In particular, the Company shall not be responsible for the unavailability of VTS due to the fact of its suppliers and third party partners. The Company or the VAR disclaim responsibility for the reliability, truthfulness, accuracy or adequacy of the information made available through VTS by Users. The Licensee is solely responsible for the above information to third parties. Accordingly, Licensee guarantees the Company or VAR against any claim or action by a third party based on this information and indemnify the Company or VAR for all consequences (damages, expenses, including attorney fees, etc. .) or any judgment in favor of those third parties against the Company or the VAR by an enforceable court decision. Licensee commit, for himself and Users, to not pursue unlawful objectives, upload, transmit or distribute viruses, illegal, malicious, misleading, violating decency, to third parties or to their rights, or encouraging the pursuit of illegal activities to interfere with VTS, servers or networks connected to VTS or interrupt them. The Company or the VAR does not check the validity and lawfulness of the data entered or accessed by Licensee and activities performed by the Licensee via VTS. Licensee is responsible for his data, or any content he or Users broadcast or the use he or Users make from VTS and more broadly the compliance by the Licensee and Users, and guarantees the Company or VAR against any claim of a third party thereto and shall indemnify the Company or VAR of the consequences (damage, convictions, costs, including court and attorney, etc.) of such a request. It is the Licensee to ensure that he has the hardware, software and means to use VTS. Licensee may not modify, reproduce or hack VTS and / or not to modify or create another website or software to mislead potential customers and let them believe that this Website or the Software is VTS or associated with the Company. If the computer on which this Software is loaded is attached to a network, this Software must not be accessible by any other user on such network.   • Limitation of Use The parties agree that this Agreement shall not be proffered by either party in another jurisdiction as evidence of any concession or as a waiver of any position taken by the other party in that jurisdiction or for any other purpose.
