Contingent Waiver Program Clause Samples

The Contingent Waiver Program clause establishes a mechanism by which certain rights or obligations are waived only if specific conditions or events occur. In practice, this means that a party's waiver of a contractual right—such as a claim for damages or enforcement of a provision—will only take effect if a defined contingency, like the achievement of a milestone or the occurrence of a triggering event, is met. This clause is used to provide flexibility in contract enforcement, allowing parties to manage risk and incentivize performance by making waivers conditional rather than automatic.
Contingent Waiver Program. If an employee does not use the employee tuition waiver benefit program or does not use the full six credit hour benefit during a semester or summer, then the spouse or dependents (up to the age of 26) of the employee may receive a tuition waiver for that semester or summer. The spouse or dependent may use up to six credit hours not used by the employee to enroll in eligible courses on a space-available basis per term. This contingent waiver may be used by up to two individuals during any given term.
