Contract File. The related Contract File and the contractual documents contained therein constitute the entire agreement with respect to the Contract between the Obligor and Seller, and there is no verbal understanding or modification, which would affect the terms thereof. The Contract File contained each of the documents listed on the Contract File.

Contract File. With respect to a Contract, the related Contract File contains, in all material respects, the documents required to be contained therein pursuant to this Agreement.
Contract File. (a) The Company agrees that no report relating to the Owner Operator’s conduct or performance may be used against them in the grievance procedure nor at arbitration unless such report is part of the contract file.
(b) No report may be placed on the file or constitute a part thereof unless a copy of the said report is sent to the Owner Operator within ten (10) business days after the date of the Owner Operator’s alleged infraction, or of its coming to the attention of the Company, or of the Company’s alleged source of dissatisfaction with them.
(c) Any unfavorable report concerning an Owner Operator shall be withdrawn from that contract file after a period of eighteen (18) months from the date of the alleged infraction, provided there has been no re-occurrence of an infraction of the same or similar nature during that eighteen (18) month period.
(d) The Company agrees that there will be only one (1) contract file for each Owner Operator.
Contract File. As to each Contract other than a Land Home Contract, (a) the original copy of the Contract, (b) the original title document issued to the applicable Contract Owner as secured lender or agent therefor for the related Manufactured Home, unless the laws of the jurisdiction in which the related Manufactured Home is located do not provide for the issuance of any title documents for manufactured housing to secured lenders, (c) evidence of one or more of the following types of perfection of the security interest in favor of the applicable Contract Owner as secured lender or agent therefor in the related Manufactured Home granted by such Contract, as appropriate: (1) notation of such security interest on the title document, (2) a financing statement meeting the requirements of the UCC, with evidence of recording in the appropriate offices indicated thereon, or (3) such other evidence of perfection of a security interest in a manufactured housing unit as is customary in such jurisdiction, (d) the assignment of the Contract from the Manufactured Housing Dealer to the applicable Contract Owner, if any, including any intervening assignments, and (e) any extension, modification or waiver agreement(s). Contract Owner: Bank of America, FSB, (with respect to the Contracts listed on Annex 1 of the Contract Schedule), Bank of America National Trust and Savings Association (which also may include Contracts owned by its wholly-owned subsidiary, Security Pacific Financial Services of California, Inc.) (with respect to the Contracts listed on Annex 2 of the Contract Schedule), Security Pacific Housing Services, Inc., (with respect to the Contracts listed on Annex 3 of the Contract Schedule), and any of their respective successors and assigns. In the event that there is more than one Contract Owner under this Agreement, the rights and obligations of each such Contracts Owner and the Servicer with respect to such Contract Owner hereunder shall only relate to the Contracts owned by such Contract Owner.
Contract File. The Assignor shall deliver to Westlake or WPM by or before the Closing Date, a Contract File for each Contract, which includes:
A. The Contract; and
B. All related documents, including certificate of title, necessary for the enforcement of, collection on, and security interest in the Unit related to, the Contract, as applicable. As of the date of this Agreement, certificates of title related to the Contracts identified in Schedule B have not been delivered to Westlake or WPM.
Contract File. The Related Documents pertaining to a particular Pledged Receivable. Contract Rate. With respect to a Contract, the annual rate at which interest accrues on such Contract. Contract Schedule. Collectively, the schedule of Contract Files attached to the (i) first Sale Assignment and (ii) each subsequent Sale Assignment delivered pursuant to the Developer Transfer Agreement, as may be amended from time to time pursuant to the terms thereof. The Contract Schedule shall set forth the following information with respect to each Contract File listed thereon:
Contract File. The credit application and investigation, all documents of insurance, and all other documentation in possession of Seller relating to a Contract. Contract Rate: The per annum rate of interest to be paid by an Obligor as provided in a Contract. Cut-off Date: April 7th 2003, after which date Seller will no longer process payments received from or on behalf of Obligors.
Contract File. The original or a photocopy of the Underlying Contract, executed by the Claimant; and
