Contract Settlement. This Contract must be returned to us upon any settlement. Prior to any settlement as a death claim, due proof of death must be submitted to us. Any paid-up annuity, cash surrender or death benefits that may be available are not less than the minimum benefits required by statute.
Contract Settlement. When a Contract has expired under any section of Article IV of this Contract or Policy Circular P9.05, Contract Default, the Provider Agency shall be prohibited from incurring any additional obligations of Contract funds. The Department may allow costs that the Provider Agency could not reasonably avoid during the Expiration process to the extent that said costs are determined to be necessary and reasonable.

Contract Settlement. The Termination Document must be signed in order to proceed with the final verification of accounts relating to the present Contract and subsequent final settlement.
9.14.1. The final verification of accounts relating to the present Contract shall be carried out in a term that is no longer than 15 calendar days calculated from the termination notice date send by the Party requesting the Contract termination, or from the expiration date of this Contract.
9.14.2. In order to sign the Termination Document, the Parties shall settle the certain, particular and demandable benefits due to each other, which shall appear in said document.
Contract Settlement. The Company may require the Certificate Agreement to be returned to the Home Office prior to making any payments. All sums payable to or by the Company under this Certificate Agreement are payable at the Home Office. EVIDENCE OF SURVIVAL Where any payments under this Certificate Agreement depend on the recipient being alive on a given date, proof that such person is living may be required by the Company. Such proof may be required prior to making the payments. ALTERATION OR MODIFICATION All changes in or to the terms of the Contract or the Certificate Agreement must be: (1) made in writing; and (2) signed by the President or Secretary of the Company. No other person can alter or change any of the terms or conditions of the Contract or Certificate Agreement. The Company reserves the right to: (1) not accept any new Certificate Owners into the Contract as of a specified date; (2) discontinue the Fixed Account option for any new Certificate Owner as of a specified date; and not accept future deposits into the Fixed Account from existing Certificate Owners.
Contract Settlement. We may require that the Contract be returned before making any annuity income payments or processing a full Surrender.
Contract Settlement. 1. Upon successful completion of the contract, the Contractor shall notify the Department, on forms provided by and in a manner prescribed by the Department, of all expenditures made during the term of the contract.
2. The Department may disallow any expenditure listed by the Contractor provided that the Department notifies the Contractor of such disallowance within 30 days of receipt of notification under L.1.above, and the disallowance is because:
a. the expenditure was properly in a category that the Department had refused to pay, or
b. the expenditure was not supported by sufficient records, or
c. the expenditure was not made to deliver the services described in this Part I, or
d. the expenditure was excessive in the opinion of the Department.
3. In the event that the Department disallows any expenditure, the Contractor shall have the right to appeal the decision to the Commissioner, provided that it submits its appeal in writing within 60 days of notification of the disallowance. The Department shall have the burden of demonstrating the appropriateness of the disallowance. The decision of the Commissioner shall be final.
4. The Department shall compute the difference between the total payments it made to the Contractor and the Contractor's total expenditures as defined herein
5. If the Contractor's expenditures exceed the maximum allowable payments made by the Department under this contract, the Department shall have no obligation to make additional payments to the Contractor.
6. If the Contractor's total expenditures were less than the total payments made by the Department, the Contractor shall comply with the provisions regarding Surplus/Excess Payments as set forth herein.
Contract Settlement. 4.5.1.1. Once the Contract is terminated for any reason, the Parties shall proceed to carry out the Final Settlement Certificate within a period of ninety (90) days, according to the format defined by ENEL. In the event that the Supplier fails to issue the Settlement Certificate within the period provided in this clause, ENEL may proceed unilaterally to carry out such settlement.
Contract Settlement. The Company may require this Contract to be returned to the Home Office prior to making any payments. All sums payable to or by the Company under this Contract are payable at the Home Office.
