Contractor’s Warranties and Representations. Contractor represents that its staff is knowledgeable about janitorial and custodial services and warrants that it will use best efforts to provide above described services in a professional, timely manner and in accordance with the applicable specifications set forth herein and/or with the standards, either by law or regulations, or industry practice or standard. Contractor further warrants and represents that it has become fully acquainted with the conditions, facts and circumstances relating to providing the services required under this Agreement. The failure or omission of Contractor to acquaint itself with existing conditions, facts and circumstances shall in no way relieve it of any obligation with respect to this Agreement. Contractor warrants that any bid, quote or proposal submitted for award under this contract is adequate for the full and reasonable performance of the Scope of Work for which it was submitted and there are no underlying or undisclosed fees or costs.

The Contractor represents that its staff is knowledgeable about and experienced in performing the Work required in this Contract and warrants that it will use the best skill and attention to provide above described Work in a professional, timely manner. The Contractor warrants and represents that it shall be responsible for all subcontractors working directly for it, as well as for their Work product, as though the Contractor had performed the Work itself.

The Contractor is fully qualified to act as the general contractor for the required Services and has, and shall maintain, any and all licenses, permits or other authorizations necessary to act as the general contractor for, and to perform the Services. The Contractor is familiar with the site at which the Services are to be performed. The Contractor warrants and represents that it shall be responsible for all subcontractors working directly for it, as well as for their work product, as though Contractor had performed the Services itself. The Town Administrator may, in writing, require the Contractor to remove from the work site any employee or subcontractor the Town Administrator deems incompetent, careless or otherwise objectionable. If equipment, materials and supplies are to be included as part of the Services provided, all equipment, materials and supplies so included and provided by the Contractor are to be of the most suitable grade for the purposes intended. When requested, the Contractor shall furnish the Town for approval the name of the manufacturer, the model number and other identifying data and information respecting the performance, capacity and rating of the machinery and other mechanical equipment which is incorporated in the Services provided. Machinery, equipment and materials installed and / or used without the prior approval shall be at risk of rejection.
