Common use of Cost of Works Clause in Contracts

Cost of Works. 75. The Subdivider, when selling any lots on the Phase II Plan shall include in the price thereof the costs of the Phase II Works in order that a purchaser shall not be required to pay any of the cost thereof over and above the purchase price paid to the Subdivider for the said lot save and except the payment of development charges or Municipal Act rates which may be required to be paid to the Municipality by third party purchasers from the Subdivider in accordance with and as contemplated in section 40 of this Agreement.

The Subdivider, when selling any lots on the Phase II 3 Plan shall include in the price thereof the costs of the Phase II 3 Works in order that a purchaser shall not be required to pay any of the cost thereof over and above the purchase price paid to the Subdivider for the said lot save and except the payment of development charges or Municipal Act rates which may be required to be paid to the Municipality by third party purchasers from the Subdivider in accordance with and as contemplated in section sections 40 and 41 of this Agreement.

The Subdivider, when selling any lots on the Phase II III Plan shall include in the price thereof the costs of the Phase II III Works in order that a purchaser shall not be required to pay any of the cost thereof over and above the purchase price paid to the Subdivider for the said lot save and except the payment of development charges or Municipal Act rates which may be required to be paid to the Municipality by third party purchasers from the Subdivider in accordance with and as contemplated in section 40 paragraph 35 of this Agreement.
