Common use of COUNCIL'S DUTY TO NOTIFY Clause in Contracts

COUNCIL'S DUTY TO NOTIFY. 32.1.1 Where Council has made a decision to introduce changes in service delivery, program, organisation structure or technology that are likely to have significant effects on employees, Council shall notify the employees who may be affected by the proposed changes and the unions to which they belong. 32.1.2 ‘Significant effects’ include the position/s being declared surplus to Council’s staff establishment, major changes in composition, operation or size of the workforce or in the skills required, elimination or diminution of job opportunities, promotion opportunities or job tenure, alteration of hours of work, need for retraining or transfer of employees to other work or locations and restructuring of jobs. Provided that where the Enterprise Agreement makes provision for alteration of any of the matters referred to herein an alteration shall be deemed not to have significant effect.
