CSEA Rights. 5.1.3 5.3.1 CSEA shall be provided with one (1) full copy of all Board Agendas (packets) and minutes at the time of their publication. Distribution of copies shall be provided to the Chapter President and Labor Relations Representative. Copies of the Board Agendas (packets) and Minutes will be placed in the CSEA mailbox located in the District office. This shall constitute full and sufficient notice to CSEA of all Board actions or decisions.
5.3.2 Within thirty (30) days after the ratification of this Agreement and subsequent ratified agreements, the District shall post on its website a copy of this Agreement and any ratified changes.
5.4 The right District shall provide CSEA with the following lists:
5.4.1 A bargaining unit list on October 1 of each year which shall include the unit member's name, classification, hours per day, days per year, site and immediate supervisor
5.4.2 On September 1 of each year and upon written request by CSEA, the District shall provide CSEA with a seniority list for all classifications in the bargaining unit.
5.5 Upon written request, the District shall provide release time without loss of compensation for no more than two (2) CSEA delegates to use institutional buildingattend the Annual Conference.
5.6 Upon request, facilities, and standard office equipment, in accordance the District shall provide release time without loss of compensation for unit members to conduct necessary CSEA business. CSEA agrees to reimburse District for all expenses associated with Board policy and this section.
5.6.1 CSEA Negotiation Team members shall be granted reasonable period of release time without loss of compensation for the Civic Center Act, at reasonable times, purposes of negotiations.
5.6.2 The CSEA Chapter President or designee shall be entitled to 60 hours of release time each year for the purpose of conducting chapter business and related matters. Such use will be at no cost unless special services are required as determined by the Immediate Management SupervisorCSEA business.

The exercise of this right shall be granted pursuant to this section:the responsibility of the individual employee.
5.1.10 The Employer shall not contract out work if there are employees at work or on layoff who can perform the work in question.

Such access shall activity does not be utilized in a manner that will disturb, disrupt, or otherwise interfere with the work school programs 24 and/or duties of any employee unit members and will not interfere with the right of unit members to refrain from 1 listening or speaking with a CSEA representative. Where a school facility is requested, CSEA shall 2 obtain advance permission from the Superintendent or designee regarding the time, place and type of 3 activity or business to be conducted. A reasonable and customary fee may be assessed for expenses 4 incurred by the District related to utilities, security, cleanup and any unusual wear or the education damage as a 5 result of any students of the District.

5.1.9 Release time 16 5.1.7 The right to conduct one (1) two-hour orientation session on this Agreement 17 for CSEA activities bargaining unit members during regular working hours within thirty (30) calendar days after the 18 execution of this Agreement.
19 5.1.8 The Association shall have the right to designate a representative to conduct a 20 fifteen (15) minute informational meeting to newly hired unit members. Such meetings shall be granted pursuant to this section:21 conducted at the conclusion of the District’s new employee safety training orientation or any similar 22 meetings held by the District.

CSEA Rights. CSEA shall have the following rights in addition to the rights contained in any other portion of the Agreement:
5.1.1 The right of access at reasonable times by a reasonable number of authorized CSEA representatives to areas in which Unit Members work, provided that access to Unit Members shall be limited to nonworking hours and non-assigned times such as breaks, duty-free lunch periods, and before or after working hours. Such access shall not be utilized in a manner that will disturb, disrupt, or otherwise interfere with the work of any employee of the District or the education of any students of the District.
5.1.1.1 CSEA staff members, officers, job stewards or other official representatives shall provide the Immediate Management Supervisor of the area with reasonable advance notice for purposes of such access and shall, prior to contacting an employee, make his/her presence known to the employee’s Immediate Management Supervisor. Any member of the CSEA field staff who wishes access to District premises shall notify the Vice Chancellor of Human Resources of his/her identity.
5.1.1.2 CSEA job stewards shall be permitted incidental use of District telephones and e-mail to contact Unit Members for union representation purposes relative to rights afforded under this Agreement.
5.1.2 The 4.1.1 CSEA shall have the right to use without charge institutional post notices of activities and matters of CSEA concern on employee bulletin boards, mailboxes at least one of which shall be provided in each school plant in areas frequented by employees, and CSEA shall provide the administration with a copy of the school notice at the approximate time of posting. CSEA may use the regular District mail system, service and other District means of communication employee mailboxes for the posting or transmission of information or notices concerning CSEA matterscommunications to employees.
5.1.3 The right 4.1.1.1 All CSEA Executive Board members and mutually agreed upon CSEA representatives will be assigned a District email address and provided reasonable access to use institutional building, facilities, and standard office equipment, in accordance with Board policy and the Civic Center Act, at reasonable times, District computers for the purpose of conducting chapter business accessing CSEA or school district related email. Such access will be limited to off work time and related matterswill not disrupt the workflow of other employees. The District will designate appropriate computer access points.
4.1.2 The right to reasonable use, without charge, of institutional facilities, equipment, and buildings at reasonable times. Such use will shall be at no cost unless special services are required as determined by the Immediate Management Supervisor.
5.1.4 The right to review Unit Members’ personnel files and any other records dealing with Unit Members when accompanied by the Unit Member or on presentation of a written authorization signed by the Unit Member.
5.1.5 The right to receive, upon request, a complete “hire date” roster of all Unit Members, indicating the Unit Member’s present classification, department and location assignment. The right to receive, upon request, a complete roster of all Unit Members by hours in paid status, indicating total hours in paid status for seniority purposes, present classification, department and location assignment.
5.1.6 The right to receive, upon request, copies of written reports that are public records requested in accordance with state lawDistrict policies and past practice.
5.1.7 4.1.3 The right to receive copies one copy of applications the complete Board packet exclusive of that which is properly omitted due to governmental agencies for grantthe Brown Act, fundingby the CSEA President and designee concerning meetings of the Board of Trustees no later than 2 business days prior to the meeting, or approval when such grantin the case of special circumstance, fundingas the information is available.
4.1.4 The right upon request to be supplied twice annually or more often by mutual agreement with a complete electronic file of the entire bargaining unit by name, seniority date, address, home phone, position classification, job site, location, and status indication i.e.: chapter member, or approval service fee payer. A copy of Victory Club members will involve the employment of additional classified employees. No employment of classified employees under such grant or funding shall occur until CSEA has been provided a reasonable time to review and commentbe supplied.

5.1.3 5.3.1 CSEA shall be provided with one (1) full copy of all Board Agendas (packets) and minutes at the time of their publication. Distribution of copies shall be provided to the Chapter President and Labor Relations Representative. Copies of the Board Agendas (packets) and Minutes will be placed in the CSEA mailbox located in the District office. This shall constitute full and sufficient notice to CSEA of all Board actions or decisions.
5.3.2 Within thirty (30) days after the ratification of this Agreement and subsequent ratified agreements, the District shall post on its website a copy of this Agreement and any ratified changes.
5.4 The right District shall provide CSEA with the following lists:
5.4.1 A bargaining unit list on October 1 of each year which shall include the unit member's name, classification, hours per day, days per year, site and immediate supervisor
5.4.2 On September 1 of each year and upon written request by CSEA, the District shall provide CSEA with a seniority list for all classifications in the bargaining unit.
5.5 Upon written request, the District shall provide release time without loss of compensation for no more than two (2) CSEA delegates to use institutional buildingattend the Annual Conference.
5.6 Upon request, facilities, and standard office equipment, in accordance the District shall provide release time without loss of compensation for unit members to conduct necessary CSEA business. CSEA agrees to reimburse the District for all expenses associated with Board policy and this section.
5.6.1 CSEA Negotiation Team members shall be granted a reasonable period of release time without loss of compensation for the Civic Center Act, at reasonable times, purposes of negotiations.
5.6.2 The CSEA Chapter President or designee shall be entitled to 60 hours of release time each year for the purpose of conducting chapter business and related matters. Such use will be at no cost unless special services are required as determined by the Immediate Management SupervisorCSEA business.

CSEA is not to use the email system to send emails to the entire district. Site representatives shall have access to mall boxes for distribution of CSEA materials. The District agrees to provide a location at the District Mail Room for CSEA to receive correspondence.
6.4 Upon written request, CSEA shall be supplied with information concerning the financial resources of the District, including financial reports and related mattersaudits, preliminary budget requirements and allocations, agendas and minutes of Board meetings, and such other information that will assist CSEA in developing intelligent, accurate, Informed and constructive programs on behalf of bargaining unit members.
6.5 CSEA shall be provided with one (1) full copy of all Board Agendas (packets) and Minutes at the time of their publication. 5.1.9 Release 6.7 Upon written request, the District shall provide CSEA with the following lists:

6.7.2 A list of all newly hired, transferred, promoted, demoted, terminated, retired or resigned bargaining unit members at the beginning of each quarter.
6.7.3 On September 1 of each year and upon written request by CSEA, the District shall provide CSEA with A seniority list for all classifications in the bargaining unit.
6.7.4 A list of substitutes bimonthly, which will include the name of the substitute, the initial date of assignment and the person and/or position for whom they are substituting and if vacant, the position control number.
6.8 The District shall provide release time for no more than two (2) CSEA activities delegates to attend the Annual Conference.
6.9 Upon written request, the District shall provide release time without loss of compensation for bargaining unit members who are Association State Officers and/or committee members to conduct necessary CSEA business. CSEA agrees to reimburse District for all expenses associated with this section. (EC 45210)
6.10 CSEA Negotiation Team members shall be granted pursuant to this section:reasonable period of release time without loss of compensation for the purposes of negotiations.

5.1.9 Release time for CSEA activities 2.1.7 The Association shall be granted pursuant four hundred dollars ($400) per person (not to exceed three (3) unit members) to attend the CSEA Annual Conference. CSEA requests for expense reimbursement from the District for unit members attending other professional conferences shall be considered on a case by case basis prior to such attendance. 2.1.8 The Association may initiate grievances concerning Association rights granted by this section:Article II only. Such grievances may be initiated at Level Two of the Grievance Procedure.
2.1.9 The District will notify the CSEA President/designee when a new employee is scheduled to meet with the Human Resources Department to receive orientation information. [Negotiated 2013]
2.1.9.1 The CSEA President/designee shall, if available, attend this meeting to provide the employee with CSEA-related information. If the CSEA President/designee is not able to attend, the only CSEA-related information provided to the new employee will be the Association “Welcome Letter.” [Negotiated 2013]
2.1.9.2 If the CSEA President/designee is not able to attend the meeting, the District shall inform him/her when and where the new employee will report to work so that the CSEA President/designee can provide the employee CSEA-related information at the work site. [Negotiated 2013]
2.1.10 Subject to an agreed upon plan between the District and CSEA, officers and representatives of CSEA shall be granted reasonable release time on SBCP days to address unit members concerning union business and/or to present staff development programs sponsored by CSEA.
2.1.11 A supervisor shall grant leave (released time) to a CSEA representative for the purpose of conducting union business if such leave would not constitute a cost to the District and would not adversely impact the need for work to be completed in a timely manner. Union representatives will notify department supervisors or site administrators of their intent to visit and/or of their arrival at a given work location. They will be permitted entry upon registering as a visitor. In no event shall the release time exceed ten (10) hours per month. Any issues regarding implementation of this section shall be referred immediately to Human Resources for resolution. [Negotiated 2012]
