Common use of CSEA Rights Clause in Contracts

CSEA Rights. 3.1 All CSEA business, discussions, and activities will be conducted by unit members or CSEA officials outside established work hours as defined in Article 7 herein, and will be conducted in places other than District property, except when: 3.1.1 an authorized CSEA representative obtains advance permission from the Superintendent or designee regarding the specific time, place and type of activity to be conducted; 3.1.2 the Superintendent or designee can verify that such requested activities and use of facilities will not interfere with school programs and/or duties of unit members as defined in Article 7, and will not directly or indirectly interfere with the right of employees to refrain from listening to or speaking with a CSEA representative; and 3.1.3 the CSEA may be assessed a reasonable fee for any unusual use of utilities, requirements for security, custodial services and any unusual wear or damage, in conjunction with the approved use of District property as provided in 3.1.1 and 3. 3.2 The CSEA may use the school mailboxes and bulletin board spaces designated by the Superintendent subject to the following conditions: 3.2.1 all postings for bulletin boards or items for school mailboxes must contain the date of posting or distribution and the identification of the organization together with a designated authorization by the CSEA President; 3.2.2 a copy of such postings or distributions must be delivered to the Superintendent or designee at the time of posting or distribution; and 3.2.3 the CSEA will not post or distribute information which is defamatory to the District or its personnel, subject to the immediate removal by the District. 3.3 CSEA shall have the right to use up to a total of fifteen (15) employee days or 120 hours of paid leave for its officers or representatives to use for local, state, or national conference attendance of for conducting other business pertinent to the CSEA. Users of this leave shall be excused upon providing written notice of their intent to be absent. Such notice must be presented by the employee to the employee’s immediate supervisor at least five (5) workdays before the leave commences. This leave shall be charged in units not less than one (1) hour. CSEA shall have the right to request additional release time in accordance with Education Code 45210. 3.3.1 With prior permission from the employee’s immediate supervisor [such permission shall not be unreasonably withheld], unit employees shall have the right to receive release time to attend CSEA chapter meetings which occur outside of normal District hours, 7:30 a. m. – 4:00 p.m. Unit employees who receive such release time shall have 30 days to make up that time. 3.4 Prior to any Board of Education meeting, the President of the CSEA and the Chairperson of the Bargaining Team shall each receive the same expanded agenda and minutes made available to the public through the normal distribution process. The CSEA Labor Relations Representative shall be notified via email that the Board Agenda is posted for viewing. 3.5 At the time of employment and each time there is a change in classification of a unit member, that unit member will receive from the District, a copy of the applicable job description and related employee assignment information such as monthly and hourly rates of pay, regular work site and regular work shift. 3.6 Upon execution of this Agreement, representatives of CSEA and the District shall work together to type, reproduce, collate, and bind copies for distribution. The District will give to CSEA the required number of copies for distribution to each member of the bargaining unit. The District shall notify the President of CSEA of new employee placements into bargaining unit positions so that a copy of the Agreement can be distributed. If, during the life of this Agreement, there are amendments, the District will prepare and give to CSEA copies of the amendment sufficient for distribution to all unit members.

CSEA Rights. 3.1 All CSEA businessshall have the following rights in addition to the rights contained in 4 any other portion of this Agreement, discussionsthe Education Code, or the Government Code of the 5 State of California: 6 6.1.1 The right of access at reasonable times to areas in which employees work. One copy shall be sent to the chairperson of the CSEA 20 negotiating team. 21 6.1.6 The District recognizes the need and affirms the right of CSEA to designate Site 22 Representatives from among employees in the bargaining unit. CSEA reserves 23 the right to designate the number and the method of selection of Site 24 Representatives. CSEA shall notify the District in writing of the names of the 25 Site Representatives and the group they represent. If a change is made, the 26 District shall be advised in writing of such change. 27 6.1.7 Site Representatives shall be entitled to seek and obtain assistance from CSEA 28 staff personnel at mutually agreed upon times between the employee and the 29 immediate supervisor. 30 1 6.1.8 A seniority and location roster will be conducted posted at each job site by unit members or CSEA officials outside established work hours as defined in Article 7 hereinOctober 15 2 following the opening of school. CSEA Rights. 3.1 All CSEA business, discussions, and activities will be conducted by unit members or CSEA officials outside established work hours as defined in Article 7 herein, and will be conducted in places other than District property, except when: 3.1.1 an authorized CSEA representative obtains advance permission from the Superintendent or designee regarding the specific time, place and type of activity to be conducted; 3.1.2 the Superintendent or designee can verify that such requested activities and use of facilities will not interfere with school programs and/or duties of unit members as defined in Article 7, and will not directly or indirectly interfere with the right of employees to refrain from listening to or speaking with a CSEA representative; and 3.1.3 the CSEA may be assessed a reasonable fee for any unusual use of utilities, requirements for security, custodial services and any unusual wear or damage, in conjunction with the approved use of District property as provided in 3.1.1 and 33.1.2. 3.2 The the CSEA may use the school mailboxes and bulletin board spaces designated by the Superintendent subject to the following conditions: 3.2.1 all postings for bulletin boards or items for school mailboxes must contain the date of posting or distribution and the identification of the organization together with a designated authorization by the CSEA President; 3.2.2 a copy of such postings or distributions must be delivered to the Superintendent or designee at the time of posting or distribution; and 3.2.3 the CSEA will not post or distribute information which is defamatory to the District or its personnel, subject to the immediate removal by the District. 3.3 The CSEA will exclusively receive released time from duties for the processing of grievances past the Informal Level of the grievance procedure, Article 4 herein, for unit members who are designated as CSEA grievance representatives subject to the following conditions: 3.3.1 by no later than ten (10) days following the signing of this Agreement the CSEA will designate in writing to the Superintendent five (5) unit members who are to receive released time and the sites that are to be represented by each. 3.3.2 twenty-four hours prior to release from duties for grievance processing the designated representative informs his immediate supervisor in order that an adequate substitute may be obtained, if such is necessary; and 3.3.3 that such released time shall be limited solely to representing a grievant in a conference with a management person, beyond the Informal Level and in no way shall this provision include use of such time for matters such as gathering information, interviewing witnesses, or preparing a presentation. 3.3.4 CSEA shall have the right to use up to a total of fifteen (15) employee days or 120 hours of paid leave for its officers or representatives to use for local, state, or national conference attendance of for conducting other business pertinent to the CSEA. Users of this leave shall be excused upon providing written notice of their intent to be absent. Such notice must be presented by the employee to the employee’s immediate supervisor at least five (5) workdays before the leave commences. This leave shall be charged in units not less than one (1) hour. CSEA shall have the right to request additional release time in accordance with Education Code 45210. 3.3.1 With prior permission from the employee’s immediate supervisor [such permission shall not be unreasonably withheld], unit employees shall have the right to receive release time to attend CSEA chapter meetings which occur outside of normal District hours, 7:30 a. m. – 4:00 p.m. Unit employees who receive such release time shall have 30 days to make up that time. 3.4 Prior to any Board of Education meeting, the President of the CSEA and the Chairperson of the Bargaining Team shall each receive the same expanded agenda and minutes made available to the public through the normal distribution process. The CSEA Labor Relations Representative shall be notified via email that the Board Agenda is posted for viewing. 3.5 At the time of employment and each time there is a change in classification of a unit member, that unit member will receive from the District, a copy of the applicable job description and related employee assignment information such as monthly and hourly rates of pay, regular work site and regular work shift. 3.6 The District shall provide CSEA the names of newly hired unit members listed on the governing Board agenda. This information shall include the unit members’ work location and hours of assignment. CSEA will furnish new unit members with a welcome packet that will be distributed by the District during the on-boarding process. 3.7 Upon execution of this Agreement, representatives of CSEA and the District shall work together to type, reproduce, collate, and bind copies for distribution. The District will give to CSEA the required number of copies for distribution to each member of the bargaining unit. The District shall notify the President of CSEA of new employee placements into bargaining unit positions so that a copy of the Agreement can be distributed. If, during the life of this Agreement, there are amendments, the District will prepare and give to CSEA copies of the amendment sufficient for distribution to all unit members.
