Common use of Customer to Develop and Implement EIP Clause in Contracts

Customer to Develop and Implement EIP. (a) The Customer will develop and implement an EIP for the stormwater reuse that: (i) ensures risks will be adequately managed; (ii) complies with the Environment requirements; and (iii) is approved by CWW (which approval shall not be unreasonably withheld) and, if required, by the EPA and DHHS.‌ (b) To assist the Customer to develop the EIP, CWW will give the Customer an example document with elements that may be included in an EIP. This sub-clause in no way relieves the Customer from its responsibility and obligation to develop and implement a compliant EIP or any other Plan. (c) The Customer will review each EIP each Year during the term of this Agreement to ensure it continues to comply with the Environment Requirements.‌ (d) If an amendment or variation to an EIP is required from time to time to ensure continuing compliance with the Environmental Requirements, the Customer will submit the draft, amended EIP to CWW for review and approval.‌ (e) Each EIP, as approved by CWW under clause 5.2(c), forms part of this Agreement and any review, comment or approval by CWW of the EIP does not relieve the Customer from responsibility to develop and implement a compliant EIP or any other Plan.
