Daily Contract Quantity. 4.1.1 The DCQ for the Term of this Agreement is as per Annexure – 2 of this Agreement. 4.1.2 During the Term of this Agreement, the Buyer shall be obligated to take and pay, or pay for if not taken Sales Gas as per the provisions of this Agreement. 4.1.3 During the Term of this Agreement, the Sellers shall supply and deliver the Sales Gas to the Buyer at the Delivery Point failing which Sellers shall be liable for Price Adjustment as per the provisions of this Agreement. 4.1.4 If Additional Gas Quantities are available with the Sellers, then subject to acceptance by the Buyer, such quantities can be delivered and offtaken as per Clause 4.4 of this Agreement.

Daily Contract Quantity. 4.1.1 The Awarded Sales Gas Quantity for the Term of this Agreement is SCMD. 4.1.2 Subject to Clause 4.1.3 and 4.1.4, the Daily Contract Quantity (“DCQ”) shall be equal to Awarded Sales Gas Quantity. 4.1.3 Sellers shall have a right to increase or decrease the DCQ up to 10% of the Awarded Sales Gas Quantity on Quarterly basis by providing at least one (1) Month’s advance written notice to the Buyer. 4.1.4 For the Quarter commencing on April 1 and ending on June 30, the DCQ shall be 105% of the Awarded Sales Gas Quantity. 4.1.5 During the Term of this Agreement, the Buyer shall be obligated to take and pay, or pay for if not taken Sales Gas as per the provisions of this Agreement. 4.1.6 During the Term of this Agreement, the Sellers shall supply and deliver the Sales Gas to the Buyer at the Delivery Point, failing which Sellers shall be liable for Price Adjustment as per the provisions of this Agreement. 4.1.7 If Additional Gas Quantities are available with the Sellers, then subject to acceptance by the Buyer, such quantities can be delivered and offtaken as per Clause 4.4 of this Agreement.

Daily Contract Quantity. (a) The Daily Contract Quantity is the Average Daily Contract Quantity set forth in the chart in Section 2.3(B). Seller will make available to the Buyer a volume of Gas on each Day of the Term up to 103% of the applicable Daily Contract Quantity for such Day, on a Firm basis and according to Buyer’s nominations and schedules provided to and worked out with Seller in accordance with Sections 2.5 and 2.6, and otherwise in accordance with this Agreement. (b) Buyer may request that Seller deliver a higher volume of Gas on a given Day or Days, and Seller shall inform Buyer whether Seller agrees to deliver such a higher volume of Gas. All such additional volumes are interruptible by either Party unless otherwise agreed.

No later than thirty (30) days before the start of the Second Contract year, Sellers shall provide DCQ which shall be between ninety percent (90%) to one hundred percent (100%) of the Awarded Sales Gas Volume as per Annexure- 2 of this Agreement. 4.1.3 During the Term of this Agreement, the Buyer shall be obligated to take and pay, or pay for if not taken for Sales Gas as per the provisions of this Agreement. 4.1.4 During the Term of this Agreement, the Sellers shall supply and deliver the Sales Gas to the Buyer at the Delivery Point failing which Sellers shall be liable for Shortfall Penalty as per the provisions of this Agreement. 4.1.5 Sellers and Buyer shall deliver and offtake Gas quantities available in excess of DCQ on reasonable endeavour basis.
