Damages Disclaimers and Limitations. WAHBE shall not be liable, regardless of the form of action, whether in Contract, tort, negligence, strict liability or by statute or otherwise, for any claim related to or arising under this Contract for consequential, incidental, indirect, or special damages. In no event shall WAHBE’s aggregate liability to Contractor under this Contract, regardless of the form of action, whether in Contract, tort, negligence, strict liability or by statute or otherwise, for any claim related to or arising under this Contract, exceed the maximum compensation. Contractor shall not be liable, regardless of the form of action, whether in Contract, tort, negligence, strict liability or by statute or otherwise, for any claim related to or arising under this Contract for consequential, incidental, indirect, or special damages. The disclaimers of certain damages and the damages limitations in sections 16.B. and 16.C. shall not apply to damages, expenses, losses, fees, liabilities, costs or other amounts arising from Contractor’s indemnification obligations.
