Common use of Date of Observance Clause in Contracts

Date of Observance. (a) Should the provincial or Federal Government(s) proclaim a day in lieu of any of the holidays listed in 16.01(a), the day proclaimed shall become the holiday for the purpose of interpreting this Article. (b) When a paid holiday falls on a Saturday and/or a Sunday, and another day is not proclaimed in lieu thereof in accordance with paragraph (a), a day off in lieu thereof will be given on a working day immediately preceding or immediately following the paid holiday, to be chosen by the Corporation.

Date of Observance. (a) Should the provincial Provincial or Federal Government(s) proclaim a day in lieu of any of the holidays listed in 16.01(a)16.01, the day proclaimed shall become the holiday for the purpose of interpreting this Article. (b) . When a paid holiday falls on a Saturday and/or or a SundaySunday for employees scheduled to work Monday through Friday, and another day is not proclaimed in lieu thereof in accordance with paragraph (a), a day off in lieu thereof the employee will be given on a working day immediately preceding or immediately normally observe the following Monday as the paid holiday, to be chosen by the Corporation.

However should the Employer decide to operate on the Monday, then the paid holiday will be scheduled at a time in lieu thereof in accordance with paragraph (a), a day off in lieu thereof the future. Where operational needs are adequately met employees will be given on a working day immediately preceding or immediately following the paid holiday, to be chosen by the Corporationthis time off in conjunction with future days off.
