Observance. (a) When a holiday specified in Section 1 of this Article falls on a Saturday, the preceding Friday shall be recognized as the holiday. When a holiday specified in Section 1 of this Article falls on a Sunday, the following Monday shall be recognized as the holiday. (b) When a holiday specified in Section 1 of this Article falls on a regularly scheduled day off, the employee shall have the choice of receiving an alternate eight (8) hours of compensatory straight time or straight-time pay. Part-time, seasonal, and job share employees will receive a prorated amount of compensatory time or straight-time pay based on the calculation in Section 3(b). (c) However, the Parties recognize that some positions must be staffed on holidays, and that employees in these positions cannot be released from duty on those holidays. Part (a) of this Section shall not apply to employees in these positions and the holiday shall be observed on the actual day specified in Section 1. Employees filling such positions will be notified in writing prior to hiring or when their work assignment is changed that they may have to work on certain holidays.

Observance. 4.12.1 The due observance and fulfilment of the provisions of this policy insofar as they may relate to anything to be done or complied with by the insured, and are not already conditions precedent, will be a condition of this policy. Any waiver by the insurer of any provision will not prevent the insurer from relying on such term or condition or condition precedent in the future. 4.12.2 In the event of a breach of any condition in the policy, and without prejudice to any of the insurer’s other rights, the insurer may reject or reduce claims connected with the breach providing the insurer can demonstrate some prejudice. 4.12.3 In the event of a breach of any condition precedent in the policy, and without prejudice to any of the insurer’s other rights, the insurer may reject or reduce claims connected with the breach, and continue the policy on such terms as the insurer may determine and if any payment on account of any such claim has already been made the insured will repay forthwith all payments on account to the insurer.

ObservanceEmployees shall enjoy the same number of holidays, regardless of variations in work weeks. Holidays which fall on Sunday are observed on the following Monday. Holidays which fall on Saturdays shall be observed on the preceding Friday. Holidays which fall during a vacation period or when a worker is absent because of illness shall not be charged against the employee’s vacation or sick leave balance. When the observed holidays fall on an employee’s scheduled day off, the day shall be added to the employee’s STO balance.
