Common use of Default; Xxxxxx and Enforcement Clause in Contracts

Default; Xxxxxx and Enforcement. Any misrepresentation of a party contained herein or any breach of a covenant or agreement contained in this Tax Agreement may be pursued by the Owners or the other party or parties to this Tax Agreement pursuant to the terms of the Declaration of Trust, the Lease or any other document which references this Tax Agreement and gives remedies for a misrepresentation or breach thereof.

Any misrepresentation of a party contained herein or any breach of a covenant or agreement contained in this Tax Agreement may be pursued by the Owners owners of the Bonds or the other party or parties parties, if any, to this Tax Agreement pursuant to the terms of the Declaration of Trust, the Lease or any other document which references this Tax Agreement and gives remedies for a misrepresentation or breach thereof.
