Common use of DEFECTIVE MANAGEMENT INFORMATION Clause in Contracts

DEFECTIVE MANAGEMENT INFORMATION. 5.1 The Supplier acknowledges that it is essential that the Authority receives timely and accurate Management Information pursuant to this Framework Agreement because Management Information will be used by the Authority and the Contracting Bodies to inform strategic decision making and will allow the Authority to calculate the Management Charge and rebate amounts pursuant to paragraph 2 of Framework Schedule 2 (Charging Structure). 5.2 When an MI Report: 5.2.1 contains any material errors or material omissions or a missing mandatory field; or 5.2.2 is submitted in an incorrect format, for example by using an incorrect MI Reporting Template; or 5.2.3 is not submitted by the Reporting Date (including where a Nil Return should have been filed), then the Authority may deem the failure to submit an MI Report correctly to be an "MI Failure".
